The push to end the nomination of Appellate Court Judge Sonia Sotomayor to the Supreme Court is coming especially from the far right. They say that she is a bully, an activist judge, a dim bulb, an incomplete woman, and a lesbian. Err. . .that is right, some of the far end of the Conservative spectrum have alleged that Judge Sotomayor is a lesbian. While the notion for many in the LGBTI community has some appeal to it, it seems odd that some would use that as a reason to deny her a spot on the nation’s High Court.
The allegations on the last two come from the fact that Sotomayor divorced her husband in 1983 and never remarried. There is no direct proof that Sotomayor is a lesbian. While she is a divorced woman who never remarried and never had children, there are no rumors of her owning her home with anyone else, and no indication that she has dated anyone since the divorce. These allegations and rumors go hand in hand with the notion of what the Far Right sees as being the role of a woman. It goes back to the old German phrase- kirk, kinder, kuchen or church, children, kitchen. To them, a woman is not a woman unless she marries a man and has a dozen children. That was, of course, the view of women for quite some time in Western culture, and one that has fallen by the wayside already. As for Sotomayor being a bully, she is forceful, according to much of what has been said. Again, this goes back to the notion that a woman should be quiet, obedient and dumb.
Judge Sotomayor may be a lesbian, but even that should not disqualify her from sitting on the bench. All indications are that Sotomayor is only an activist judge if you squint really hard and take the line that an activist judge is someone who follows the laws as they are written. Indeed, one study published back when Bush II was in office found that most of the activist judges, that is a judge who ignores the law and inserts their own opinions into a case, were Conservatives and not Liberals. In one case, a woman that Bush II tried to have elevated to the Federal bench had to literally find a way around the case at hand in order to rule in favor of corporation who was a defendant in the case. The corporation was being sued for ruining the health of a young man, and this particular judge had to find a piece of law which forced the case to be started from the beginning. The young man died before the second round of suits could have been followed through. Sotomayor, in the bulk of her cases, has followed the law as it is written.
As for Sotomayor being a dim bulb, the problem is that even the brightest of jurists do not write brilliant opinions more than a handful of times in their life. Just because her opinions are not brilliant does not mean that she is not qualified to be a Supreme Court judge.
The Far Right want to use everything in their arsenal to attack Sotomayor. If this means personal smears and attacks, then they do not care. “Damn the torpedoes, full steam ahead” is their mantra even if it means colliding with an ice berg.
Sexuality aside, my one hope is that Sonia Sotomayor is a friend of the gay and lesbian community and that she can see that the case law, precedent, the law and the Constitution are on our side. It is likely that Judge Sotomayor will be facing a case concerning Prop 8, and the issues of same-sex marriage in the near future.

I followed this pretty thoroughly and do not recall ever seeing any allegation, or even a throw away snide remark, suggesting that Sotomayor is a lesbian.

yeah when i first saw her picture i thought she looked like a lesbian and was quite suprised to find out thhat she had actually married…..since then what i have heard her say leads me to believe that she at the very least hates/despises men as well as hates white people, which is a given….so, you nominate a racist man-hater to the supreme court, thats the libs for you…

Oh boy, where do you all live – some alternative universe? There is nothing that suggests that Sotomayor is a lesbian. However, I believe that roughly 60% of lesbians of her age group were married at some point, according to statistics.

I love the usual Liberal Straw Man argument brought up here. “Some of the far end of the conservative spectrum”? Really, got a name? My main concern
is her Judicial Activism, her membership in the Race Hate Group La Raza, her bigoted comments against the Evil White Man and her record of cases being overuled by a higher court. Could the fact that she is a Closet Lesbian, if that is the case, affect her personal judgement in rulings or expose her to Blackmail? Is it not an issue because people are so damn P.C. nowadays? Personally, I have no concern with her sexuality. My issues only concern the Court following the Constitution as written, not making up law, I.E. Roe v Wade or letting the Federal Government usurp States Rights as is happening as we speak.
Anyway, have a good debate, but don’t make up stuff just because you hate Conservatives.

I’m sorry if I didn’t want to rush back out and find the damn slime sites again. Incidentally, since there are a lot of the same tactics used by the Right, don’t bother kvetching just because I don’t want to name every single slime ball Right Winger who wants to make that argument. On the subject of ‘making things up’, please quit with the damn incest arguments. I mean, for crying out loud, they’re moronic. As for polyamory, just wait until some Muslim somewhere sues for that right based upon the First Amendment. Not allowing for multi-partner marriages is a violation of their religious rights. Come to think of it, not recognizing same-sex marriage is ALSO a violation of the first amendment since some religions actually DO believe that gays and lesbians have the right to get married. Those religions are already performing religious ceremonies, some of which are Christian.
Nice going destroying the Constitution.

Another problem is the fact that the woman who passed this along spoke Neder Deutch and not Hoch Deutch. Certain things stick even after four semesters of German. My great-grandmother spoke a form of German which hasn’t been really spoken in Germany since around the 1700′s.
I’m sorry that my WordPerfect like all idiotic American word processing softwear does not acknowledge foreign languages. Incidentally a kirk is also the old spelling for a Church, and does show up primarily in Scottish English.
I am mildly dyslexic/dysgraphic. About the only language where I am actually able to spell without any problems is Japanese.

‘Kirche’ is not pronounced ‘Kirk’, not even in Plattduetsch or Neder Deutsch. It is pronounced with two syllables “kir-che”, with a soft ‘ch’, as it is after the vowels “i”, and “e” and “u-umlaut” (as in “Kueche”). Take this from someone born in Germany with a degree in Germanistic. Or leave it, of course.

But I don’t think the wingnuts need to worry about that one–gay rights is not on Obama’s Supreme Court nominee litmus test. As a professor he taught his constitutional law students that same sex marriage did not have any constitutional ramifications. Becky, I need to correct you in one area. Proposition 8 only defined Marriage as between a Man and a Woman. It did not, aside from what Ted Olson or Jerry Brown thinks, make Gay Marriage Illegal. If Gay Marriage is legal, then Polygomy should be legal, Multiple Partner Marriages should be legal as well as Marriiage between Siblings and First Cousins. All those things are illegal in most States. This isn’t Bigotry, it is common sense. That being said, as a Conservative / Libertarian, I could give a Rat’s Ass what people do to themselves, but I also realize Society cannot function in a free for all with no rules of behavior and continue to function. The problem with all these issues is where do you draw the line without disenfranchising or damaging others. Like everything else in life, it’s complicated.
