Gay panic in Uganda’s Kill-the-gays bill

Gay PanicYet another close look at one of the more objectionable passages in Uganda’s Anti-Homosexuality Bill 2009.

(quotations from the Bill are in italics)

5. Protection, assistance and payment of compensation to victims of homosexuality.

“Victim” in this instance is defined as : a person who is involved in homosexual activities against his or her will.

(1 ) A victim of homosexuality shall not be penalized for any crime commuted as a direct result
of his or her involvement in homosexuality.

So if you kill someone, you can simply claim that they tried to make you have homosexual sex? Better yet, if you’re going to kill someone, pick someone you know is gay.

Gay Panic is the name used for a legal defense argument that an assault or murder was commited as a result of a homosexual overture by the victim of the assault. Just last year, this was used successfully in Illinois, where Joseph Biedermann was acquitted of the murder of his neighbour, Michael Hauser. Biedermann inflicted the 61 stab wounds, went home, showered and then went to the hospital. He claimed the deceased had attempted to sexually assault him.

The Gay Panic defense was disallowed in the 1998 Wyoming murder of Matthew Shepard, but only because the state of Wyoming doesn’t allow temporary insanity as a defense.

Not only does Uganda’s government intend to sentence gay people and their allies to death, they want to make it easier for civilians to murder homosexuals too. I suppose it cuts back on expenses.
