Montana GOP Following Texas GOP In Trying To Recriminalize Homosexuality

The Montana GOP is following the lead of the Texas GOP by suggesting that they would push to keep homosexuality illegal.  According to their platform, which has inexplicably been pulled from their site, “We support the clear will of the people of Montana expressed by legislation to keep homosexual acts illegal.”  Um. . . “homosexual acts” are legal in the United States.  They have been now for. . .oh almost a decade now.

Of course, the Montana GOP is probably not trying to outlaw such “homosexual acts” as a lesbian making a nice mustard vinaigrette for her salad, or feeding her cat breakfast, or reading a book by Virginia Woolf.  It is likely that they want to outlaw sexual acts between two consenting adults of the same-sex, and maybe a few acts between people of the opposite sex such as oral and anal intercourse.

Of course, sexual acts between consenting adults of the same or opposite sex are not illegal in the United States because of a 6 to 3 decision handed down by the Supreme Court in 2003 called Lawrence v. Texas.  This seven year old news is simple- Lawrence won and all sodomy laws in the United States were struck down.  While this would not be a comfort to President Bill Clinton since, technically, what he and Monica Lewinski did was illegal in Washington, DC, that is only because he got into trouble prior to that decision.

According to Think Progress, the Court decision determined that the Texas law had the effect of “making it a crime for two persons of the same sex to engage in certain intimate sexual conduct [and that]  violates the Due Process Clause.”

What is more- Montana’s anti-homosexual sex law was struck down in 1997 because it violated a person’s right to privacy.

Of course, Montana’s GOP may be trying to ban other homosexual acts such as taking out the trash, driving cars, watching television, voting, but the probability is that they really would much rather stop lesbians and gays from having “icky” sex the same way that Michael Huckabee claims to not want to call the way in which two women or two men have sexual intercourse.

    Why doesn’t the GOP get it’s noses out of people’s private lives and take care of the rip-offs being perpetrated upon the American people? Worry about your own business for a change, people. I’m disgusted by this fixation with other people’s sex lives.

    Montana, Texas, Nevada, Oklahoma… In some states it’s not just the GOP, it’s the laws on the books.  Virginia, Oklahoma, and North Carolina still repress sodomy (mainly homosexual sodomy). See http://www.glapn.org/sodomylaws/usa/usa.htm  Local newspapers in Oklahoma still publish the names, ages, addresses, and mugshots of gay men arrested for sex in public places.

    what I would like to know is just who’s impression of sins have mounted up so high that someone thinks it’s the right thing to raliy anyone to punish someone they don’t know or care to for touching someone, especialy their own kid? Homosexual activity? Lets play political football and maybe we can what? Sex laws are not going to fly,,,ever anymore.

    I lived in Dallas and visited Austin numerous times. Pinching ones nose in between those two destinations is advisable.

    Homosexuality is not a sin according to the Bible. Any educated Christian would know that. Scholars who have studied the Bible in context of the times and in relation to other passages have shown those passages (Leviticus, Corinthians, Romans, etc) have nothing to do with homosexuality. These passages often cherry-picked while ignoring the rest of the Bible. The sins theses passages are referring to are idolatry, prostitution, and rape, not homosexuality.
