A US Representative has claimed that President Barack Obama’s Department of Justice is not doing its job to defend the federal Defense of Marriage Act with all its gusto like pushing out reams of information about how homosexuality is bad and same-sex marriage will result in rivers running “red with blood and yellow with urine, and dogs will be seen eating cat food throughout the land.” Oh and, “Fire and brimstone coming down from the skies! Rivers and seas boiling!” “Forty years of darkness! Earthquakes, volcanoes…” “The dead rising from the grave!” “Human sacrifice, dogs and cats living together… mass hysteria!” To this point, US Representative Lamar Smith of Texas has asked the Federal Courts to serve as intervenor-defendant in two cases regarding DOMA that will becoming before the First Circuit US Court of Appeals soon.
On 5 October, the Alliance Defense Fund claimed that the DoJ is not mounting any kind of defense of DOMA. Dale Schowengerdt, a lawyer for the ADF stated “We should be strengthening and protecting marriage, not subjecting it to a hostile takeover through the courts. If the Obama administration won’t defend marriage, we are ready and willing to do so.”
It is, of course, rather rare for a court to grant a request like this after the case has been heard by the district judge. That will not stop people like the ADF from trying to have themselves placed into the position of being the ones defending an unconstitutional law before the courts. If Attorney General Eric Holder really wanted to get on the LGBT Community’s good side, he would abandon trying to appeal these rulings and allow for these laws to be deemed unconstitutional now that they have been ruled against.
