First it was the National Organization for (Heterosexual, Cis-Gender) Marriage, and now it is the Family Research Council filing amici on behalf of the Defense of Marriage Act, and using the same kind of bogus arguments which are their stock in trade as an SPLC recognized hate group. The courts have ruled that DOMA, or part of it, is unconstitutional because of a combination of the 10th and 14th Amendments.
The FRC through their pet legal group the Thomas More Society and their lawyer Paul Linton, has offered up this legal rationalization for why DOMA should be kept in place:
1. There is no Federal Constitutional Right to enter into a same-sex marriages.
2. US law reasonably reserves marriage and its benefits to opposite sex couples so as to promote both responsible procreation of children and the raising of those children by their biologically-related mother and father.
“Why should Americans be forced to encourage, as well as support with their tax dollars, same-sex relationships, which obviously — and by their very nature — cannot produce children or provide both the mothers and fathers that evidence proves beyond peradventure that children need to fully develop and flourish?” asked Tom Brejcha, president and chief counsel for the Thomas More Society in Chicago.
The rationales are rather stretched given the fact that many straight marriages are incapable of producing children, including many who are elderly at the time that they get married. Their argument is also rather problematic since there is no Federal Constitutional Right to get married- PERIOD. Finally, the evidence is actually that having two mothers or two fathers does not harm children or societies, though single parenthood, which is where they get their data, does tend to produce children with more problems than families which have two parents.
In fact, all of their arguments have been proven to be inaccurate and wrong over the last two years, but they continue to make them as if they were, somehow, accurate and real. This is why the FRC was listed as a hate group by the SPLC along side NOM. They prefer to make crap up instead of relying upon actual research or logic.
