In order for there to be a Constitutional Amendment to take ban same-sex marriage in the United States, it will take two-thirds majorities in both the House and the Senate and of the states. This is unlikely to happen any time soon given the problems that The Republican Party are having managing to get more than a bare majority in the House and not taking over the Senate at all.
In the wake of the New York’s historic vote on marriage equality, Representative Michele Bachmann, who opposes same-sex marriage, did state that this was something that was up to the people of the state of New York. She did, though, call for a same-sex marriage to be banned across the nation through a Constitutional Amendment.
She discussed this issue with FOX News’ Chris Wallace. This came via ThinkProgress:
BACHMANN: In New York state, they have passed the law at the state legislative level and, under the 10th amendment, the states have the right to set the laws that they want to set.
WALLACE: So even though you oppose it, then its ok from — your point of view — for New York to say that same-sex marriage is legal.
BACHMANN: That is up to the people of New York. I think that it’s best to allow the people to decide on this issue. I think it’s best if there is an amendment that goes on the ballot, where people can weigh in. [...]
WALLACE: But you would agree, if its passed by the state legislature and signed by the governor then that’s the state’s position.
BACHMANN: It’s state law. And the 10th amendmet reserves to the states that right.
Bachmann was also asked whether or not she is a ‘flake’.
To this, she stated:
“I think that would be insulting to say something like that because I’m a serious person.
I’m 55 years old. I’ve been married 33 years. I’m not only a lawyer, I have a post-doctorate degree in federal tax law from William and Mary. I’ve worked in serious scholarship … my husband and I have raised five kids, we’ve raised 23 foster children. We’ve applied ourselves to education reform. We started a charter school for at-risk kids. I’ve also been a state senator and member of the United States Congress for five years.”
For the most part, what Bachmann shows is an act. She is very intelligent. She is not stupid. The thing is, that she presents this rather flaky persona the same way that Sarah Palin does. Palin showed that she was a very intelligent person when she first ran for office. There is a tendency among many Republican women to present this rather less than intelligent demeanor because they feel that they need to.
