From Senator Charles Grassley’s Twitter account: “Constituents askd why I am not outraged at PresO attack on supreme court independence. Bcause Am ppl r not stupid as this x prof of n law.”
Okay, what’s “n law”? President Obama was a lecturer in constitutional law at the University of Chicago Law School. I don’t think Grassley understands how easy it is to go from “n law” to “the n-word” to “n-word law.” And calling the President “stupid” – well, that’s almost as unacceptable as calling out “You lie!” during the State of the Union Address.
The Supreme Court’s independence? Frankly, Senator, most of us aren’t as stupid as your Party’s well-indoctrinated base. There is nothing independent about the Roberts Court. We know about Justice Thomas’ wife’s PAC, and how he and Justices Alito and Scalia have not recused themselves from cases where they have demonstrable ties to the case. We have seen this court rule in favor of corporations and the Republican Party too many times to consider this court “independent” any more. The Citizens United ruling threw out 200 years of American devotion to the individual over corporate and business interests. We are living in fear of this court, with its close ties to the Republican Party, ruling on the photo ID laws and repressive abortion laws. How far will this court go to support the Party and deny rights to the American people? Those who are pushing the “personhood amendments” are doing so for the express and expressed purpose of pushing the amendments to the Supreme Court, which they expect to overturn Roe v. Wade, ending legalized abortion in America for the foreseeable future and driving us back to illegal abortions and death and reproductive disability for women. How independent is a Supreme Court when extremists fully expect that court to rule in their favor? The Roberts Court is on track to go down in history as one of the most political of all time, and one of the most tainted. Justice Thomas should be impeached for his disregard for tax law and Court financial disclosure rules.
No, Senator Grassley, the President isn’t stupid. He was admonishing this court to prove it is truly independent by ruling justly and fairly in the case of the Patient Protection and Affordable Care Act, and not bow down to their moneyed friends in high Republican places. He was telling the Court to live up to its Constitutional obligation to be fair and balanced and unprejudiced.
The justices of the Supreme Court should not be exempt from the ethics standards that all other Federal judges and Judicial branch employees must live by. Now that we have finally seen how that exemption works, how a Supreme Court can be so blatantly and obviously unethical, maybe we can see a movement to impose those ethics standards on the Supremes.
