Quelle surprise! Attorney General Eric Holder will not call a grand jury against himself. Who could have ever imagined that in their wildest dreams?

Deputy Attorney General James Cole has said that the decision not to convene a Grand Jury against the AG based on the Contempt of Congress vote held yesterday is consistent with standing policies from administrations from both parties. The Department of Justice sent a letter to Speaker of the House John Boehner informing him of the Department’s decision. In the view of the Department of Justice, withholding information from Congress is not a crime, especially when the President has sealed those documents with Executive Privilege.

In addition to the Fortune magazine story by Katie Pavlich, there are now other ATF agents coming forward to speak to the press, and they are refuting the idea that the department let guns walk into Mexico. On Friday night’s NBC Nightly News, Michael Isikoff interviewed former ATF agent William Newell who was a high ranking member of the operation, and Newell confirmed the core of what Pavlich wrote – that the problem with the operation was in prosecution, not execution of the tracking plan.

It has also been revealed that the offer Holder made to House Oversight Committee Chairman Darrell Issa was a synopsis of the materials that they have refused to turn over to the committee. It consists in part of internal discussions concerning the program and possible investigations into bringing charges or disciplinary action against members of the Department. Issa refused the offer.
