Marriage Equality…it’s what brings us together today…alright, enough with the Princess Bride references. Tonight on The Rachel Maddow Show, Dr. Maddow interviewed one of the primary lawyers pushing for marriage equality over the last decade, and looks into the various arguments advanced by the lawyers regarding the Defense of Marriage Act or DOMA.
One thing that must be noted is the fact that if DOMA falls, same-sex marriage will not be spread across the nation. Instead, same-sex marriage will still be illegal in all those states that do not recognize it, but the Federal Government will have to recognize it. This is still an important victory, and the rest of DOMA will likely fall fairly soon based largely on the case Loving v. Virginia.
By and large, the attacks on same-sex marriage outside the courts have come in the form of illogical reasoning. Unfortunately, US v. Windsor has shown that not all of the Justices are willing to consider the issue of DOMA rationally. Instead, they are more than willing to ignore the reality of DOMA and maintain their discriminatory nature due to the fact that they maintain a dislike of lesbians, gays, bisexuals and transsexuals.
The reality is that at least some part of DOMA will be going down soon. At least we can hope.
