Court Order Covering Obergefell and Arthur Extended To Year’s End



Judge Timothy Black has extended the temporary restraining order preventing Ohio from ignoring the marriage between John Arthur and James Obergefell. The order is now in effect until 31 December.

Arthur is dying from ALS, also known as Lou Gehrig’s disease. The two married in Maryland last month, and sued Ohio officials including Governor John Kasich in order to have their marriage recognized by the state so that the two can be listed as spouses on Arthur’s death certificate.

At issue is the fact that Arthur’s grandfather stipulated that only his decedents and their spouses can be buried in the family plot. Should Obergefell not be listed as Arthur’s spouse on the death certificate, he would not be allowed to be buried there.

The order is limited just to the two men, and not to anyone else. This has not stopped attempts to get the order overturned by anti-gay activists.
