Congressional advocates for LGBT immigration reform launched a ridiculous strategy on Thursday with the reintroduction of the Uniting American Families Act. The only sensible piece of the strategy being  the release of a letter from 48 House members urging the Obama administration in part to suspend deportations faced by married gay spouses.  This launch however is little different to the past 16 years of fighting for Reform in the arena of green cards for same sex couples.

The Thursday letter from Rep. Zoe Lofgren of California and Democratic colleagues called on Atty. Gen. Eric Holder and Secretary of Homeland Security Janet Napolitano to mitigate the discrimination faced by binational married couples following the administration’s February announcement that it considers the Defense of Marriage Act to be unconstitutional. The 1996 law bars married gay couples from the citizen sponsorship rights afforded heterosexual married couples.

The release of the letter was timed with the reintroduction of UAFA, which would help keep most binational couples together by making family-based immigration inclusive of same-sex partners of U.S. citizens and permanent residents. The reintroduction of the UAFA makes no sense to me and is a derivative of the Immigration Equality lobby and quest for survival of the organization.

Two reasons:
1. They already had UAFA caste for success back in 2009 – with a record number of co-sponsors and a majority on both houses with President Obama at the helm. What happened – they tied UAFA to the quest for comprehensive immigration reform (CIR)- spent our  donor money on schmoozing immigration  Latina groups and landed us in the lame duck session in a rah rah for the DREAM ACT – pursuant to their newfound aliances which served to exclude UAFA from its only possible chance of succeeding as a stand alone Bill;

2. Now the climate is different – while DADT has passed and DOMA is up for repeal – why are we wasting time with UAFA- when in fact DOMA will accomplish much more.  We do not need UAFA if DOMA is repealed. Additionally UAFA is not in good shape. Now that marriage is available to same-sex couples in some states, UAFA must change its language from the OLD version – to make way for a more definitive contractual nexus between the parties, otherwise Senator Feinstein will NOT sign on to it.  I have explained this concept in numerous articles.

That said instead of pursuing UAFA – all that energy by Immigration Equality and other organizations should rather be put into special interim Visas for Binational couples – Sunset Visas, similar to the R1 Visa Program and Fiance Visas worded differently to use terms like contractual nexus instead of marriage.

I have no doubt unfortunately – that all the gay.in organizations are going to do follow the Pied Piper  again and assume that the immigratin equality lobby knows what they are doing. It is up to binational couples to YELL reintroduction of UAFA is not good enough, hopeless and a waste of time.

VIA THe Advocate:- ” Lofgren, ranking member of the House Subcommittee on Immigration Policy and Enforcement, called on the Department of Justice and DHS to suspend deportation proceedings and a put a temporary hold on green card adjudications for gay married couples pending either legal resolution or legislative repeal of DOMA.

“Taking these steps would not flout or disrespect existing law, as it would not provide permanent immigration relief to married couples of the same sex, currently prohibited by Section 3 of DOMA,” Lofgren wrote. “Rather, it would prevent the potentially irreparable harm that would be caused by application of a law that is currently under review by the courts and the U.S. Congress.

“As the country grapples with the question of whether DOMA is constitutional and should be the law of the land,” Lofgren continued, “we ask that you take steps to temporarily preserve the status quo and protect American citizens and their spouses from avoidable harm.”

Lofgren’s letter follows a similar one sent to Holder and Napolitano last week by 12 senators, including John Kerry of Massachusetts and Kirsten Gillibrand of New York, urging relief for such couples.

But thus far the administration appears unwilling to do so. Asked whether DHS has responded to the senators’ letter, DHS spokesman Adam Fetcher told The Advocate in a statement, “The administration will respond to the members of Congress directly. Pursuant to the Attorney General’s guidance, the Defense of Marriage Act remains in effect and the Executive Branch, including DHS, will continue to enforce it unless and until Congress repeals it or there a final judicial determination that it is unconstitutional.”

TIME for some real leadership on the part of LGBT organizations and advocates.

NOTE MY POSITION: I support Comprehensive Immigration Reform.  I Support the repeal of DOMA. I applaud the reintroduction of ENDA today.  I m angry at the wool over the eyes introduction of UAFA. I want a special VISA NOW for couples in same-sex marriages/ civil Unions/ and fiances.

This administration ought to be ashamed of not having supported and effected this RIGHT before the Republicans took over the House! Advocates in the LGBT organizations – please wake up and change the strategy NOW!

Every June for the last 11 years, the gay community in Israel celebrates gay pride in the streets of Tel Aviv. The city of Tel Aviv is bedecked in the rainbow colors for a week with the pride flag weaving from the flagpole all over the city.

This year the 11th of June will be the highlight of Tel Aviv’s pride month, with the biggest parade ever.

The parade will be accompanied by various events and parties, and is a must to participate. Join the party and enjoy, because everyone else will The upcoming parade will take place on June 10th 2011.   A few weeks before the parade itself, the organizers will publish a full list of events which usually take place before and after the parade.  As soon as this list is available, it will be published by Tel Aviv Pride.

Israel is one of the world’s most progressive countries in terms of equality for sexual minorities. Homosexuality was decriminalized in Israel over 20 years ago, and major Supreme Court decisions and groundbreaking legislation soon followed.

Some same-sex married couples are refusing to file their federal tax returns separately this tax season, as part of a movement demonstrating that they’re no longer content to quietly comply with the federal law that does not recognize same-sex marriage. And in some cases, these taxpayers will pay Uncle Sam more when they do so. Prior to recent developments in the Courts and introduction of Defense of Marriage Act repeal legislation, same-sex couples have yet been as bold; now it seems the time is right!

Same-sex couples who have married, or who have a legal status equivalent to marriage in certain states, must still file separate federal returns because the government — and therefore the Internal Revenue Service — defines marriage as a legal union between a man and a woman. “Using that definition, federal tax returns ask taxpayers to check one of five options under their filing status: single, married filing jointly, married filing separately, head of household or qualifying widow(er) with dependent child. Married same-sex partners typically file their own federal returns either as single or, if they qualify, as head of household, which has more favorable rates than the single filing status.

But many same-sex couples contend that filing as single amounts to lying about their marriage status, and that’s the message behind the “Refuse to Lie” campaign created by gay activists, which is timed to coincide with tax season.

“More people are refusing to lie on those forms, even though the government is telling them to,” said Nadine Smith, executive director of the gay, lesbian, bisexual and transgender advocacy group Equality Florida, who plans on filing a joint return with her wife, Andrea. “It would be both dishonest and deeply humiliating to now disavow each other or our marriage and declare ourselves single on our tax form.”

Nina E. Olson, the national taxpayer advocate who acts as an ombudsman for the I.R.S., acknowledged the uncertainty surrounding federal taxation of same-gender spouses in an annual report to Congress. In the report, she said that taxpayers may take a filing position without penalty if there is “substantial authority” to do so, such as a court case that hasn’t been overruled by the United States Court of Appeals. And there happen to be two such cases, which are currently on appeal.

In July 2010, the Federal District Court in Massachusetts declared the Defense of Marriage Act — the federal law known as DOMA that defines marriage as between a man and a woman — as unconstitutional in two cases; now being appealed in the First Circuit. “Thus, there may be substantial authority for same-gender spouses to take certain tax positions as married as long as the Massachusetts district court’s opinions stands,” Ms. Olson said in the report.

The Impetus clear and different to past years and now quite tempting!

The “Refuse to Lie” Web site warns same-sex couples of the risks of filing jointly, and explains different options to both adhere to the law while expressing that they disagree with it. One way to do that would be to put an asterisk by the “single” box, and then indicate at the bottom of the tax form that you are “only single under DOMA.” Another option, the site says, is to attach a note with a similar message.  Read the rest of the article here….

More Stories Finally Receive Mainstream Press: An example of upping the ante for same-sex green cards  is the publicity and strategy now afforded a  gay Long Island couple who have played by the immigration rules for more than a decade are stuck in a Catch-22 that could tear them apart just when they need each other most. This is yet another example of the latest in a push from advocates around the USA, who are asserting same-sex couple’s rights denied by federal Law, despite legitimate marriages under state law in the USA as well as according to State recognized foreign law.

New Yorker Edwin Blesch, 70, and his South African husband, Tim Smulian, 65, have been spending six months on Long Island and six months abroad to comply with Smulian’s tourist visa.  But Blesch, who has HIV, suffered several mini-strokes and other complications and is now unable to travel safely,  According to  the NY Daily News.

Smulian is his primary caregiver – but has no way to stay here permanently. The men were married in South Africa in 1999, a union that is recognized by New York State and Suffolk County.  While many may ask – well why do they simply not live in South Africa where the Constitution protects such couples, including sexual orientation and gender identity therein, this is merely one of tens of thousands of cases, that highlights this extreme inequity in the US law that defines marriage as between a man and a woman only.  It is clear that this law must finally change as we reside in a World where so many are starting to recognize that same-sex relationships are as equally valid legally as they are factually.

” They filed last month for a green card, which immigration officials normally would deny. But they’re asking U.S. Citizen and Immigration Services to use the power of discretion and make an exception for them, especially since the federal Defense of Marriage Act, which does not recognize gay marriages, is being challenged in court. (AND in respect of which Repeal legislation has been introduced)

It is a long shot. After the White House announced in February it was no longer defending the 1996 law, immigration officials put decisions on green card applications from the same-sex spouses of U.S. citizens on hold. But Homeland Security lawyers told them this week to keep following the act even as the legal challenge continues.

Today is César Estrada Chávez DAY; born March 31, 1927  and lived until April 23, 1993) – an American farm worker, labor leader, and civil rights activist who, with Dolores Huerta, co-founded the National Farm Workers Association, which later became the United Farm Workers (UFW).

After his death he became a major historical icon for the Latino community, and for liberals generally, symbolizing militant support for workers and for Hispanic power based on grass roots organizing and his slogan “Sí, se puede” (Spanish for “Yes, it is possible” or, roughly, “Yes, it can be done”). His supporters say his work led to numerous improvements for union laborers.

His birthday has become César Chávez Day, a state holiday in eight US states. Many parks, cultural centers, libraries, schools, and streets have been named in his honor in cities across the United States.

A Mexican American, Chávez became the best known Latino civil rights activist, and was strongly promoted by the American labor movement eager to enroll Hispanic members. His public-relations approach to unionism and aggressive but nonviolent tactics made the farm workers’ struggle a moral cause with nationwide support. By the late 1970s, his tactics had forced growers to recognize the UFW as the bargaining agent for 50,000 field workers in California and Florida. However, by the mid-1980s membership in the UFW had dwindled to around 15,000.

Chavez was charismatic: a self-taught rhetorical genius, he created commitment by inspiring well educated Latino idealists with undiscovered organizing potential and encouraged them to offer a liberating, self-abnegating devotion to the farmworkers’ movement. Claiming as his models Emiliano Zapata, Gandhi, Nehru, and Martin Luther King, he called on his people to “Make a solemn promise: to enjoy our rightful part of the riches of this land, to throw off the yoke of being considered as agricultural implements or slaves. We are free men and we demand justice.”

I recently had the pleasure of meeting living legend Dolores Huerta and found her one comment about   Chávez most inspiring -

When asked in an earlier interview – “You’ve endured arrests, beatings, and more. In your darkest hour, what gave you hope?”

I have to quote Cesar on this one: “You’ll always win if you don’t quit.” Think of the great movements like the women’s movement and the civil rights movement and the years that it took to make all of that happen.”

Let us make sure that their work retains its inspirational impact.

This is a teachable day for all Americans and especially for those of you who are willing to fight for the last American Civil Rights Frontier – LGBT unequivocal and non- compromising EQUALITY.

Cape Town – South African President Zuma entered Athlone Stadium in Cape Town to commemorate the South African  massacre of 69 protesters of the Apartheid pass laws,  at Sharpeville in 1964, to a great applause from supporters.  The ANC supporters were placed on one side of the stadium and the opposition parties on the other. The day has been named for Human Rights in General.  The MC speaker announced the theme  “to working together to protect the human dignity for all” – and speakers spoke passionately about the importance of  the guarantee of rights entrenched in the SA Constitution and the Bill of Rights.”

It seemed so inspiring until the first  opening speaker, Patricia de Lille the current Western Cape MEC for Social Development, and the Democratic Alliance‘s candidate for the Mayor of Cape Town in the 2011 municipal elections, came to the podium. Ms. de Lille  is also the leader of the Independent Democrats, a South African political party which she formed in 2003 during a South African floor-crossing window. On August 15, 2010, the ID merged with the Democratic Alliance, South Africa’s official opposition, and de Lille has taken on dual party membership.

As Ms. de Lille arose and started to speak, the crowd started to boo and make a lot of noise, including heckling and mocking. The crescendo became a single shrill dulling the speech to a virtual silence. But she continued.

Given the purpose of the day; had I not witnessed the extent of the spectacle for myself I would never have believed it. The crowd screamed over her and she continued with great reserve and posture to speak. Not once did she indicate anger or veer from her human rights stand in her prepared words.  Two officials came up to her microphone while she spoke to urge the crowd on the right side of the stadium to please let her speak. But their pleas were ignored. She continued to speak, clear that South Africa is not truly ready to embrace full human rights even in the context of a human rights celebrations and nor in the memory of those who died so this very day could be celebrated with an ANC president at the helm.

It was almost a riot, as police stood at the ready and people danced at the joy of the mockery – all human rights forgotten – this ought to have been a severe embarrassment to any President of any Nation in that situation. de lille was shut up by a crowd not willing to hear her or give an opposition party a voice.

All the while President Zuma sat whispering in the ear of the person sitting next to him and I taped a piece where he he held his hand in a sign of “well too bad what can iI do?”

When the President gave his speech, “Human Rights Unite us, that is what we stand for as a Nation,”  screaming across  his initial greeting,  surely he could have stood up and asked the same people for the dignity that the day was supposed to represent and for them to hear Ms. de Lille.   Instead  sat there in silence, a pattern of silence in South Africa and the rest of Africa especially on matters affecting the entrenched rights of gays, lesbian, transgender  people in Africa and the rights of women raped by 3 out of every 4 men in some townships.

Sexual orientation and gender identity are entrenched in the Bill of Rights, but each politician only spoke to racial benefits of the Constitution, citing equality and a free South Africa, which included the apartheid oppressors,  in this new unity. He kept emphasizing the freedom and worth of every human being.  Yet, very little has been done to give attention to the oppression of gays and lesbians and transgender people in South Africa.

Zuma quoted, His Excellency Nelson Mandela – “never again shall we allow oppression of any South Africans.”  Zuma continued to note that todaywe celebrate our Constitution for all South Africans  as so many sacrificed their lives for human rights. “We must celebrate the Bill of rights in this constitution nobody can take it away from us.” We must unite in condemnation of women who are raped and beaten…. we must unite and strive for a society that those who seek to trample on these hard earned rights – that is a duty of every South African.”

Then why has President Zuma failed to put his words into action – to provide the services that the people  of South Africa need as a basic human right-  and that includes woman who are being raped by the thousands each and every day in your townships. It includes the 635 women out of each 100,000 who die in childbirth because of lack of resources a number which had increased dramatically since 1994.  We also mention the fact that gays and lesbians and transgender people remain subjects pf persecution and oppression in the Township.

He then went on to talk about International affairs:  Ivorians and their plight – he asked all Africa to put Ivorian interests first. In Middle East “we reiterate our call for resolution of Palestinians and Israelis to live side bv side in peace”; he also called for harsh action against Libya and said that it a government could not bomb its own people.

(Glaring Omission WHAT ABOUT UGANDA President ZUMA and the Kill the Gays Bill?)

In conclusion he included these words.  AND EVEN WHO THEY CAN MARRY  (and I thought great he will finally mention LGBTI – but instead he said ” who they can marry based on the color of their skin!!!”

“Let us work together to protect the dignity and freedom for all…”  That includes homosexuals, gays, lesbians, gender identity, transgender dignity!  or does it President Zuma……..

Need I say more…. for now!!

COMMENTS  by Kayum Ahmed from human Rights Commission said the speech was “uninspiring” Helen Zille was uninvited and de Lille booing- he says- is indicative of racial tension in the Western Cape. He mentioned as I said abovethe President should have taken up stage to protect the speaker.

UN- HR High Commissioner Navi Pillay

Laws criminalizing homosexuality are incompatible with international human rights standards and fuel homophobia

CAPE TOWN – In light of the fact that the Ugandan pre-election parliament has been called to a seating on March 22nd, 2011 – a mere week away – where the Anti-Homosexuality Bill of Bahati and Museveni will probably be voted upon, its is critical that the President of South Africa and the ANC Party – the bastion of an anti-discrimination promise – must come out (if you will) as a matter of URGENCY to stand behind the words of the High Commissioner and Secretary General of the united Nations, with a strong statement requesting the decriminalization of homosexuality.

In September 2010 a Statement was issued by the UN High Commissioner for Human Rights, stating, inter alia, -

“In 78 countries individuals still face criminal sanctions on the basis of their sexual orientation or gender identity. The existence of criminal laws of this kind poses a serious threat to the fundamental rights of LGBTI individuals, exposing them to the risk of arrest, detention and, in some cases, torture and execution. Commonly, criminal sanctions are accompanied by a raft of other discriminatory measures that affect access to a wide range of rights—civil, political, economic, social and cultural.  We also know that criminalization perpetuates stigma and contributes to a climate of homophobia, intolerance and violence directed against LGBTI individuals.

Our first task, I believe, is to frame this squarely as a human rights issue and demand that it be tackled as such. As High Commissioner for Human Rights, I have a responsibility to encourage States to promote and protect the human rights of all people without discrimination.  Indeed, to believe in human rights is to believe in equality: equal rights for all people, regardless of who they are or where they are from.”

The General Assembly, in its resolution 60/251 establishing the Human Rights Council, entrusts the Council to promote “Universal respect for the protection of all human rights and fundamental freedoms for all, without distinction of any kind and in a fair and equal manner.”

The language of the Universal Declaration is also very clear in this respect. The preamble refers in its first line to the “inherent dignity” and the “equal and inalienable rights of all members of the human family” as the “foundation of freedom, justice and peace in the world.”

On March 10, 2011  the following was posted on the United Nations Human Rights Office of the Commissioner Website as follows:-

“Laws criminalizing same-sex relations between consenting adults remain on the statute books in more than 70 countries. They are an affront to principles of equality and non-discrimination and fuel hatred and violence—in effect giving homophobia a State-sanctioned seal of approval. UN High Commissioner for Human Rights, Navi Pillay, and UN Secretary-General, Ban Ki-moon have both called for the worldwide decriminalization of homosexuality and for further measures to counter discrimination and prejudice directed at those who are lesbian, gay, bisexual or transgender (LGBT). In recent months, a series of incidents and developments have underscored the extent and the urgency of the challenge.”

In February 2011, Malawi enacted a law criminalizing homosexuality among women. Homosexuality is already illegal for men in that county. If convicted, a defendant could receive up to five years’ imprisonment. Responding to the Malawian decision, the High Commissioner said “I have repeatedly argued that laws criminalizing homosexuality are inherently discriminatory and incompatible with existing international human right standards, including those enshrined in the International Covenant on Civil and Political Rights, to which Malawi has acceded, and the African Charter on Human and Peoples’ Rights, which Malawi has ratified.”

In Uganda, on 26 January 2011, leading gay human rights activist David Kato was beaten to death in his home outside Kampala. In the months leading up to his murder, he had been a target of a hate-campaign mounted by a local newspaper, The Rolling Stone, which printed his name, photograph and address alongside those of dozens of others the paper claimed were gay or lesbian, and called for them to be hanged.

“We must await the outcome of judicial proceedings to know who killed him and why. But whoever is responsible and whatever their motive, we know the fear felt by many lesbian, gay, bisexual and transgender individuals in Uganda and elsewhere who continue to face widespread prejudice and the constant threat of homophobic violence. Kato’s death robs them of a brave and eloquent advocate. The Ugandan authorities must act to counter this climate of hate and ensure the safety of all Ugandans,” the High Commissioner said.

Homosexuality is illegal in Uganda and a pending Anti-Homosexual Bill would broaden the criminalization of homosexuality, imposing life imprisonment or even the death penalty for anyone who is found to be lesbian, gay, bisexual or transgender or HIV positive. The Bill also includes a provision that could lead to a prison sentence of up to three years for anyone who fails to report within 24 hours the identities of any LGBT individual, including members of their own family.

Even where homosexuality is not subject to criminal sanctions, LGBT individuals continue to suffer discrimination and violence, fuelled by homophobia. In the United States, for example, the recent suicide of seven teenage boys in the space of a single month was attributed to homophobic bullying in schools. Homophobia also lay behind the shocking case of three young men, kidnapped, beaten and tortured in New York City in October 2010. According to the National Coalition of Anti-Violence Programs in the United States, 2,181 hate crimes targeting LGBT persons were recorded in 2009, including 22 murders.

In Honduras, seven transgender persons were reported murdered during a two month period between November 2010 and January 2011, bringing a total of 34 LGBT persons killed in that country since June 2009, according to the Inter-American Commission on Human Rights, Organization of American States.

In Brazil, Grupo Gay da Bahia, a long established NGO working on LGBT human rights issues, recently reported that in 2010, 250 LGBT individuals were killed because of their sexual orientation or gender identity—equivalent to one person killed every day and a half. The same source reports that more than 3,100 homosexuals have been killed in Brazil since 1980.

“Decriminalizing homosexuality is an essential first step towards establishing genuine equality before the law. But real, lasting progress cannot be achieved by changing laws alone. We must change minds as well. Like racism and misogyny, homophobia is a prejudice born of ignorance. Notwithstanding the call to all world leadership to bring an immediate end to the criminalization of homosexuality in these countries, with this call, it is incumbent on President Zuma of South Africa, the only country on the continent of Africa, with a constitution that protects the human rights of LGBTI – people, to  assume a leadership role in Africa.

This can be accomplished in a myriad of ways to include:

1. An immediate  statement by President Zuma or the appropriate office of the ANC  Government, such as the Office of Foreign Affairs, calling on Countries in Africa to decriminalize homosexuality by way of legislation including significant protections of sexual and gender minorities;

2. The immediate recall of Jon Qwelane, South Africa’s ambassador to Uganda, who has gone on the record with anti-homosexuality remarks, indicative of the fact he may well be a victim of the homophobia to which the UN Commissioner refers – alternatively a statement by Jon Qwelane calling upon Uganda to adhere to the Human Rights Declaration of the United Nations by the immediate decriminalization of homosexuality in Uganda, and the withdrawal of the Kill the Gays Anti-Homosexuality Bill authored by member of Parliament David Bahati; In the latter event if Ambassador Qwelane were to issue such a statement, he may well be redeemed in the eyes of the international community and forgiven by LGBT communities in South Africa and around the world.

3. Direction from President Zuma to the appropriate offices of South African Ministers -Education, Home Affairs, and Communication to provide for national and local promulgation of protocols for the education required to help all South Africans reconcile cultural anti-homosexuality beliefs with the International standards of Human Rights as expressed by the High Commissioner, above.

4. A statement must also be issued honoring the Ugandan LGBTI Activist David Kato, by the appropriate South African Office.

In my conversations with MP of Uganda, David Bahati, he specifically told me and I am told that he expressed the same view on his recent appearance in a Johannesburg  taping of a BBC show for Television, that the Government and people of Uganda believe and I quote his words to me “homosexuality is not a human right; Uganda is a sovereign Country and can legislate its criminal law without interference from foreign governments.”

In light of the fact that the Ugandan pre-election parliament has been called to a seating on March 22nd, 2011 – a mere week away – where the Anti-Homosexuality Bill of Bahati and Museveni will probably be voted upon, its is critical that the President of South Africa and the ANC Party – the bastion of an anti-discrimination promise – must come out (if you will) as a matter of URGENCY to stand behind the words of the High Commissioner and Secretary General of the united Nations, with a strong statement requesting the decriminalization of homosexuality.

Many young African LGBTI people have received asylum here in South Africa, – I have met personally met two gay refugees this past week.  Their soon to be published (by me) stories attest to the atrocities of homophobia and its impact on African youth – President Zuma, in providing refuge to these young people – and there will be thousands more to come- must speak out in  honor of their suffering and to curb much more.

Laws criminalizing homosexuality are incompatible with international human rights standards and fuel homophobia

CAPE TOWN – In light of the fact that the Ugandan pre-election parliament has been called to a seating on March 22nd, 2011 – a mere week away – where the Anti-Homosexuality Bill of Bahati and Museveni will probably be voted upon, its is critical that the President of South Africa and the ANC Party – the bastion of an anti-discrimination promise – must come out (if you will) as a matter of URGENCY to stand behind the words of the High Commissioner and Secretary General of the united Nations, with a strong statement requesting the decriminalization of homosexuality.

In September 2010 a Statement was issued by the UN High Commissioner for Human Rights, stating, inter alia, -

“In 78 countries individuals still face criminal sanctions on the basis of their sexual orientation or gender identity. The existence of criminal laws of this kind poses a serious threat to the fundamental rights of LGBTI individuals, exposing them to the risk of arrest, detention and, in some cases, torture and execution. Commonly, criminal sanctions are accompanied by a raft of other discriminatory measures that affect access to a wide range of rights—civil, political, economic, social and cultural.  We also know that criminalization perpetuates stigma and contributes to a climate of homophobia, intolerance and violence directed against LGBTI individuals.

Our first task, I believe, is to frame this squarely as a human rights issue and demand that it be tackled as such. As High Commissioner for Human Rights, I have a responsibility to encourage States to promote and protect the human rights of all people without discrimination.  Indeed, to believe in human rights is to believe in equality: equal rights for all people, regardless of who they are or where they are from.”

The General Assembly, in its resolution 60/251 establishing the Human Rights Council, entrusts the Council to promote “Universal respect for the protection of all human rights and fundamental freedoms for all, without distinction of any kind and in a fair and equal manner.”

The language of the Universal Declaration is also very clear in this respect. The preamble refers in its first line to the “inherent dignity” and the “equal and inalienable rights of all members of the human family” as the “foundation of freedom, justice and peace in the world.”

On March 10, 2011  the following was posted on the United Nations Human Rights Office of the Commissioner Website as follows:-

“Laws criminalizing same-sex relations between consenting adults remain on the statute books in more than 70 countries. They are an affront to principles of equality and non-discrimination and fuel hatred and violence—in effect giving homophobia a State-sanctioned seal of approval. UN High Commissioner for Human Rights, Navi Pillay, and UN Secretary-General, Ban Ki-moon have both called for the worldwide decriminalization of homosexuality and for further measures to counter discrimination and prejudice directed at those who are lesbian, gay, bisexual or transgender (LGBT). In recent months, a series of incidents and developments have underscored the extent and the urgency of the challenge.”

In February 2011, Malawi enacted a law criminalizing homosexuality among women. Homosexuality is already illegal for men in that county. If convicted, a defendant could receive up to five years’ imprisonment. Responding to the Malawian decision, the High Commissioner said “I have repeatedly argued that laws criminalizing homosexuality are inherently discriminatory and incompatible with existing international human right standards, including those enshrined in the International Covenant on Civil and Political Rights, to which Malawi has acceded, and the African Charter on Human and Peoples’ Rights, which Malawi has ratified.”

In Uganda, on 26 January 2011, leading gay human rights activist David Kato was beaten to death in his home outside Kampala. In the months leading up to his murder, he had been a target of a hate-campaign mounted by a local newspaper, The Rolling Stone, which printed his name, photograph and address alongside those of dozens of others the paper claimed were gay or lesbian, and called for them to be hanged.

“We must await the outcome of judicial proceedings to know who killed him and why. But whoever is responsible and whatever their motive, we know the fear felt by many lesbian, gay, bisexual and transgender individuals in Uganda and elsewhere who continue to face widespread prejudice and the constant threat of homophobic violence. Kato’s death robs them of a brave and eloquent advocate. The Ugandan authorities must act to counter this climate of hate and ensure the safety of all Ugandans,” the High Commissioner said.

Homosexuality is illegal in Uganda and a pending Anti-Homosexual Bill would broaden the criminalization of homosexuality, imposing life imprisonment or even the death penalty for anyone who is found to be lesbian, gay, bisexual or transgender or HIV positive. The Bill also includes a provision that could lead to a prison sentence of up to three years for anyone who fails to report within 24 hours the identities of any LGBT individual, including members of their own family.

Even where homosexuality is not subject to criminal sanctions, LGBT individuals continue to suffer discrimination and violence, fuelled by homophobia. In the United States, for example, the recent suicide of seven teenage boys in the space of a single month was attributed to homophobic bullying in schools. Homophobia also lay behind the shocking case of three young men, kidnapped, beaten and tortured in New York City in October 2010. According to the National Coalition of Anti-Violence Programs in the United States, 2,181 hate crimes targeting LGBT persons were recorded in 2009, including 22 murders.

In Honduras, seven transgender persons were reported murdered during a two month period between November 2010 and January 2011, bringing a total of 34 LGBT persons killed in that country since June 2009, according to the Inter-American Commission on Human Rights, Organization of American States.

CAPE TOWN – This Monday, March 14, 2011,  Ndumie Funda, Melanie Nathan, and a group of activists are heading to parliament to meet with the Ministry of Justice about ‘corrective’ rape, the increasingly common hate crime in which men rape lesbian women to ‘turn’ them straight or ‘cure’ them of their sexual orientation.

Some groups have endorsed a mission statement to the ministry to set up a commission to research, develop and implement needed reforms surrounding ‘corrective’ rape and the intersecting issues of sexual violence, anti-LGBTI violence and hate crimes.

Please come out to add your voice to the demand for action on these issues!

This is a place flourishing with possibility , yet tainted unless it accepts its charge – the charge of a Constitution that screams: – ‘USE me I am the example for Africa and the World.”

That was the underlying message of the week as, upon my return to the land of my birth, I stood on two stages, hoping to deliver a simple message:- You have an awesome Constitution South Africa, more inclusive than that of the United States of America, where Federal law bars same-gender marriage; however what good is it unless you live it.  You must turn your accomplishment into an achievement and you will only do that when you truly step up from the charcoals of oppression and understand your Constitutional rights, and assert them with the vigor that post Apartheid South Africa deserves.

Homosexuality is a birthright – citizenship is a birthright – love is a birthright – you are a birthright. Now Live it.

South Africa must embrace its Constitution on three frontiers:

At home in South Africa from Village to City to the steps of the Courts and Parliament – ensure that your rights are valued – speak up in large crowds – reform and educate that rape against women is a rape against your Constitution; (Amongst many other issues)

In Africa as a leading power – standing by your principles of all inclusiveness – be a light to Africa not only with your money and resources but with your hard learned principles, born from a struggle so profound – and do not be duped by those (UGANDA and the others) who say “do not interfere with our right to create sovereign laws such as criminalization and death penalties for homosexuality – because the rest of the world was not duped by the excuses for apartheid. Recall Ambassador Jon Qwelane from Uganda, he casts shame on the Constitution of South Africa through his lack of respect for it; and stop investing in Museveni until he directs his parliament to stop legislation that is un-African, discriminatory and fails to separate Church from State.

In the World -  When your house is on order – and you have truly swept out the last of the cobwebs of discrimination – the one that hides like a sleeping snake behind the excuse of ‘Africanism’ – go out to the rest of the World and say “look where we were thirty years ago – and look where we are today – we are a true Rainbow Nation – and you can come visit me in San Francisco and all my brothers and sisters and everyone in between and you can scream at us – “Republican Party – why do you fall behind South Africa – why dis you help us end apartheid and now you fail your own people – those who until they can marry and receive all federal benefits – are second class citizens – just the way we used to be?   US Congress, President Obama,  we are leaders in the world on LGBT rights and we are asking you to repeal DOMA now.

Pride, Cape Town, is more than just a party and when you yelled back and stood up today – I realized that you are ready to fight here for the rights you already own – and for the rights of all in Africa who suffer the hardship of hate and criminalization.

Thank you South Africa for teaching me, Cape Town Pride for inviting me, British Airways for getting me here and home again and to Cape Royale hotel and Victoria Junction.

Cape Town is a fantastic destination for Pride – Lets get the rest of the World here next year – watch out Sydney and San Francisco!

To a sold out crowd , Equality California will honor Attorney General Kamala Harris and Alameda County judge Victoria Kolakowski at its annual San Francisco Equality Awards, presented by AT&T. Harris will receive the Del Martin & Phyllis Lyon Marriage Equality Award. In her prior position as San Francisco District Attorney, she was instrumental in securing legal protections for the lesbian, gay, bisexual, and transgender (LGBT) community by launching specialized programs around hate crimes, same-sex domestic violence, and same-sex sexual assault. As Attorney General, Harris has refused to defend Proposition 8 in the federal challenge to overturn the marriage ban and has created an LGBT working group as part of her transition team.

Judge Kolakowski will receive the Equality and Justice Award. Kolakowski made history last year, becoming the nation’s first openly transgender judge. A trailblazing pioneer and inspiration to the LGBT community, Kolakowski has been a longtime advocate for LGBT equality, previously serving on the board of the Transgender Law Center and Equality California, where she was a founding board member.

The evening’s festivities include a 6 p.m. reception followed by a silent auction, gourmet dinner and after party. Ironically, in the very week that Ugandan activist David Kato was murdered in Uganda, after his face and name was plastered all over a tabloid declaring him gay, President Yoweri Museveni has praised  the South African government and various corporations from South Africa for investing in Uganda.  The President who concluded a state visit to South Africa told journalists that the government strongly values the South African businesses.

However does he value SA business enough to urge his Parliament to refrain from passing legislation that countries such as South Africa will find offensive?

If David Kato was the Steve Biko of Uganda why is South Africa still investing in Uganda?

Why is South Africa failing the principles of the African National Congress  – the principles that the children in Soweto and Sharpeville died for and the ideal for which Madibe Mandela gave his youth and his promise?

The Ugandan President  says his National Resistancer Movement government will continue providing ample security to the South Africa’s enterprises to continue the key role they play in the economy of Uganda. But how can the Ugandan Government guarantee the security of gay and lesbian South Africans  doing business or working in Uganda when they are criminalized and subjected to arrest?

The act of homosexual sex is considered a crime in Uganda; and A Bill will be read in Parliament that outlaws homosexuality as criminal requiring stiff sentences and sometimes death.

South African Companies are bound by the South African Constitution which guarantees South Africa’s gays, lesbians and transgender people one hundred percent equality under the SA constitution.    The question crops up – how will South Africa react to the clear criminalization of homosexuality should the Ugandan Parliament pass its anti-homosexuality legislation and what do they plan to remark as it looms for enactment?

South Africa has business like MTN the leading telecommunication company in Uganda, Stanbic Bank the bank that covers the most parts in the country then Shoprite, the leading supermarket chain among others. Museveni said that the South Africa’s enterprises in Uganda have created jobs and contributed to the national treasury through taxes.

He encouraged more South Africa’s investors to come to Uganda and tap opportunities in the East Africa common market as Ugandan products now enter duty free in Kenya, Tanzania, Rwanda and Burundi.

The questions-

1. Will Museveni start to see the light and steer the likes of MP’s such as David Bahati away from the legislation?

2.Will Museveni veto anti-homosexual legislation to protect Uganda’s economic interest and function in the greater world?

3. Will South Africa , an economic and political leader in the region, bring pressure to bear on Uganda to protect its investments?

4. If the Anti Homosexual bill is passed – what will South Africa do?

Its time now, in face of statements such as that made by Museveni last week,  that South Africa exert its influence and threaten to withdraw investment should Uganda continue its anti-gay discrimination.

President Zuma and his cabinet, and the pride of  the ANC, South Africa  must stand firmly on the shoulders of Madibe Nelson Mandela and his vision for Africa and speak out now to state that South Africa cannot and will not do business in or with a Country that singles out gays and lesbians, for discrimination via criminalization.

Not only is it contrary to the declaration of human rights but it will compromise South Africa’s own ideals and all that the apartheid resistance stood for.  The reality will be that SA and other countries in Uganda will have to tell its gays and lesbians – sorry you cannot work for our company in Uganda if you are gay!

No more Investment for UGANDA until the Parliamentarians let go of discrimination and  the lies perpetuated against homosexuals in Uganda.

Melanie Nathan; nathan@privatecourts.com Dec 29-2010; – A creditor called me one particularly bad month asking me to pay a debt I could not afford at that time. I told him I had  no money to pay the amount needed for the month and that food on the table for my kids was more important.  As he persisted, I asked the caller if he had a wife and a family and he said he did. I asked him if he understood what I was experiencing, just having lost my paying work; he responded “yes ma’am but you incurred the debt;  you knew what you were doing,” he said.  My response came from goodness knows where: Which of my kidneys do you want me to sell;” I implored, exasperated with his persistence; “my left kidney or my right one?”  To which he answered ” I don’t care which one you sell madam, your left or your right – it makes no difference to me.”

In Washington each February, the annual Conservative Political Action Conference, (CPAC)  draws thousands of conservative activists (is that an Oxymoron?) –including potential presidential candidates.  The presence of the gay Republican group GOProud, which was (along with many other groups) a co-sponsor of last year’s CPAC is planning to play a similar role this year’s event, yet to a foray of objections and boycotts of the event.

The American Principles Project announced that it would not participate in 2011, because it believes that the gay group’s “purposes are fundamentally incompatible with a movement that   - has long embraced the ideals of family and faith in a thriving civil society.”

I ask  “where is that  ‘thriving Civil society Pray show me? ” and how come it is still a thriving civil society,  given that the LGBT community has yet to see its equality under the law of the USA?  Have we ever truly seen a thriving civil society?  Not since the demise of the Bush erosion.   Gays and Lesbians have had no impact on whether society is thriving or not as without civil rights, including marriage and employment protections,  LGBT have not fully participated.

The conservative group GOProud wants a seat at the Republican and conservative table at CPAC.

At the behest of conservatives the words ‘Republicans/ conservatives’ and ‘Gay Group’ are simply unable to coexists – or at least we are told.   The  Republicans and  conservatives consider each and every American who is lesbian, gay or transgender  ‘persona non-grata’- unworthy of sitting at a table to talk issues and politics.

Several other groups have joined the American Principles Project, and the conservative news website WorldNetDaily has reported this latest development in the increasing numbers who will boycott the next CPAC  Conference.

Two of the nation’s premier moral issues organizations, the Family Research Council and Concerned Women for America, are refusing to attend the Conservative Political Action Conference in February because a homosexual activist group, GOProud, has been invited.

Deciphering: “has long embraced the ideals of family and faith in a thriving civil society” -  Do you think the society that hosts the  Kidney collector – oops I mean debt collector is a ‘thriving civil society?’ The one George W. Bush left us – and guess what -queers had no rights then too- specifically excluded.

Here we are in the Post BUSH years, after a lengthy time in the  hands of conservatives – conservative principles – no LGBT rights : how come we were not living a thriving  civil society at that time or even now for that matter? A ‘thriving civil society?’   That is precisely what our forefathers had in mind when they separated Church from State, whilst seeking religious freedoms.  Did gay people cause Bush-Cheney-Rove and their administration to bungle it up – hell we could not even serve in the military at that time, let alone get married.

In fact  that admin and now continues to effect the sending of LGBT Americans packing, exiled to foreign soil, just for falling in love with a same-sex foreigner!

A civil society is one where people share equally in the civil laws; a thriving society is one where people have healthy good full bellies and stress free lives, where money is earned and taxes are paid.  Where years of savings are not washed down the drain and where everyone has an equal shot at cures, remedies and transplants. Look at the Wall Street crooks and resulting debacle, the housing crash, mortgage meltdown,  the unemployment, dried up unemployment benefits;  what the hell is is thriving about all of that?

Now these very conservatives, who purport to have the answer for our ideal thriving society – which by their definition – such cannot be unless gays are excluded from sitting at their table;  do not want to sit at the table with GOProud because they are destroying the ideals that do not exist? How did that happen?

I have a suggestion for CPAC cowardice – why not pick the brain of a queer or two – you may just get an idea about “HOW TO” ensure and run an effective thriving civil society; from those who will appreciate the civility of separating Church law and dicta from State law and rights and not bitch slap it around the way the conservatives have done.

Okay, so now you are thoroughly confused – no worries you are in good company – so am I!

Bottom line guess what in case you did not notice, there was NO same sex marriage nor any LGBT rights while all this mayhem went on and while it continues to drench us as a society seeking our last pound of flesh, straight or queer flesh! No discrimination on the end result.

After all these years without any civil rights for the LGBT community, nor same-sex marriage, – millions of Americans are denied their basic civil rights and the ‘cowardly boycotters’ will have us believe we live in a civil society?  Civil for whom and thriving about what?

People have had their physical freedom and rights, stolen from them, such as United States Army Private Bradley Manning – what about Private Manning – waiting inside military  solitary confinement for 8 months without any charges.  I suppose that is our civil society and the ideal that the queers are going to mess with!

What is thriving about Africa right now, the rapes, the coups, the hunger, the malaria?  What is thriving about the Middle East – terrorism, bombings, kidnappings, nuclear threats, antisemitism, stoning of women, murder of lesbian daughters? What is thriving about Russia, Belarus, Europe…..  China ………..Central and South America  pray tell!  How did the queers cause all this?  Conservatives how are YOU  going to fix this entire universe of societies if you keep wasting your time with petty nonsense such as this boycotts such as this.

In conclusion sit at the table with those who share your ideals – and don’t give me that BS that you are backing out  because if you do “we will not have a thriving civil society.”  Try and find a better reason – this one does not work – and then face the fact there is no reason.

As far as my kidney is concerned – I still have both – There can never be a thriving civil society without full civil rights for all – anyway you choose to look at it, until that happens we are incomplete and you may as well take my Kidneys …..

This coming new year, 2011, Spectrum will commence its new Youth Advocacy Project;  advocating for inclusive school policies, and legislation such as the FAIR Education Act, which ensures that LGBT people are fairly and accurately included in instructional materials.

This is critical on a local and nationwide level, because a program in one such community sets the tone and advances the quest for similar such programs and spreads advocacy in the interests of legislation applicable to all in the USA.

This year’s theme  “One Love”  was  to highlight that “we are all one humanity who shaare the same love,” explains Rica Paras,the vice president of STRAP, or Transexual Women of the Philippines.  “We are in the streets because we want to declare that we exist while, at the same time, asking for compassion and sympathy [because] we are marginalized and we are seeking a quality life,” Paras told ABC-CBN  News.

“We are in the process of making sure that the anti-discrimination bill is passed in congress to protect the LGBT community.”  Bayan Muna Rep. Teodoro Casiño commented that gatherings of support such as this provide a critical element to passage of non discrimination laws, such as  the Anti-Discrimination Bill which having been stalled will stand a chance of  consideration if a critical mass were to develop;  “Congress has a macho culture. Despite its posturing that it is a democratic institution, in many ways, it is still difficult to push for democratic legislation. Plus, the fact also that the Philippines, being a predominantly Catholic country, [brings in] a religious aspect [into the congressional debates]. These are the things we are up against,” he said.

Melanie Nathan- Nov 28-2010 - Any man found engaging in sexual activities with another man should be arrested,” Odinga said at a rally on Sunday, in the Nairobi slum of Kibera. “Even women found engaging in sexual activities will be arrested.”  Speaking to his home constituency, Odinga, also a member of parliament, argued that since August census results showed the national population was perfectly split between men and women, there was “no need” for homosexuality.

“This kind of behaviour will not be tolerated in this country. Men or women found engaging in those acts deserve to be arrested and will be arrested,” Odinga said to cheers and laughter in the crowd. I believe that Kenya and the rest of the World was given a perfect NOD by the recent United Nations critical nod to arbitrary execution of gays and lesbians.

His comments came following criticism of a new constitution adopted in August with the backing of both Odinga and President Mwai Kibaki.

Some critics had argued the new basic law contained articles that were tantamount to tolerating same-sex marriages and abortion, but Odinga rejected the accusations.

“Those were lies from leaders who wanted to confuse Kenyans to reject the new law, the Constitution is very clear on that matter. It does not state anywhere that same sex marriage is legal in Kenya,” he said.

A move by neighbouring Uganda to introduce a bill that would further criminalise homosexuality and even gay rights advocacy has been described as “odious” by US President Barack Obama and sparked the ire of rights groups. 1. USA Must Lead the World by Example; Immediate Passage of US Equality Legislation or we are perceived as believing there is NO NEED for homosexuality;

2. USA must Clean House and Help the World

3. The Genocide against Gays and Lesbian in Africa is beginning- it is time to clean house, effect sanctions and boycotts against every  country in Africa that professes freedom of religion  and democracy until they provide safety and protection to gays and lesbians (LGBT)

4. If implemented to negotiate with Kenya i to provide a 60 day moratorium for gays and lesbians to leave the Country and seek refuge in other countries who must sign on for saving lives.

This is targeted hate against LGBT communities- we cannot allow the USA and world to watch…….

“Of all the hotel brands, (Kimpton is ) the most active in LGBT community,” Paisley told USA Today. “They have a website, they sponsor tons of events and they advertise in gay and lesbian media. W is very active and well respected, but they did fall behind.”

Headquartered in San Francisco, Kimpton does not miss a beat as an ever present at activist and fund raising events, often providing sponsorship. Annually the group co-sponsors an event at one their hotels to herald in  San Francisco Pride.  Last year’s was a co-sponsorship with National Center for Lesbian Rights where Kimpton also gave away rooms for the silent auction. They also provide valuable advertising dollars to LGBT publications.

What makes no sense in the San Francisco travel scene is the fact that Kimpton Hotels has been turned away from sponsoring or advertising by  San Francisco Pride , because another hotel chain, less supportive of LGBT community, has received an exclusive contract.  While we all know that SF GAy pride is hurting for funds, it is sad to note that SF Pride cannot include the very Group that now tops all Hotel Chains for travel by our community.

The app for the Manhattan Declaration was described as a “call of Christian conscience” invited users to take a stand against gay marriage by signing a document penned by certain Christian clergy, scholars and others opposed to equality. Change.org  hit hard on the app for fostering “homophobia and extreme anti-choice views” and started a petition to get Apple to remove it from the iTunes store. We wrote an extensive piece on LGR about the Manhattan Declaration and re-posted excerpts to counter the APP ATTACK on Gays. Well all effort all round may well have worked.

Today, a search for the Manhattan Declaration app at apple.com came up empty. We will try again tomorrow in case they sneak it back up! I doubt that will happen of course.    According to SDGLN Apple has a history of rejecting apps that are gay-related, yet it is the LGBT community that faithfully buys its products, especially the iPhone.  Perhaps the App is off only for this big dollar Black Friday mega shopping day to maintain our PINK Dollar mega spend.

MELANIE NATHAN    Nov 24-2010;   One of the most commented on Articles on LezGetReal is one from some time back; the LGBT community and Progressive Americans were outraged by what was called The Manhattan Declaration and this is what we wrote:

“With the potential to give all Church’s a bad rap, a diverse group of Christian leaders joined together Nov. 20, 2009,  to declare a commitment to defend the sanctity of human life, biblical marriage and religious liberty without compromise. One hundred and fifty evangelical, Roman Catholic and Eastern Orthodox signers said they were coming together to “embrace our obligation” to speak and act in support of the dignity of all human beings, marriage as the union of a man and a woman, and the freedom to express religious convictions. It is imperative that Church leaders and those of faith who disagree with this, not remain silent, but provide the backlash such hate deserves.

The 4,700-word statement, yet another reproach for the LGBT communities, named the Manhattan Declaration,  asserted: “[W]e will not comply with any edict that purports to compel our institutions to participate in abortions, embryo-destructive research, assisted suicide and euthanasia, or any other anti-life act,” the statement says, “nor will we bend to any rule purporting to force us to bless immoral sexual partnerships, treat them as marriages or the equivalent, or refrain from proclaiming the truth, as we know it, about morality and immorality and marriage and the family. We will fully and ungrudgingly (mmm not a real word…!!) render to Caesar what is Caesar’s. But under no circumstances will we render to Caesar what is God’s.”

Yet, in snide hypocrisy these so called Leaders of Catholic, Evangelical and Orthodox groups were present during the declaration and made it clear that the declaration does not have any political interest.

Horror of Horrors: The company has  approved the Manhattan Declaration app to allow users to digitally sign and “take a stand” for a call for “Christian Conscience”. The declaration defends Christian ideas of the sanctity of life, traditional marriage, and religious liberty. The app also allows you to take a brief survey which ask you questions about supporting same sex relationships and the right of choice.

Critics say it’s offensive to the gay and lesbian population and should be removed. It is indeed pure hate material and is effectively being promoted by APPLE by its mere inclusion.   It is my belief that notwithstanding the ideal of freedom of Speech would not be impinged if a Company Adopts policy to specifically exclude what it deems to be discriminatory, hateful and not in keeping with its own policy on inclusiveness and diversity.  Now this comment may not seem to make perfect legal argument at this time – however the experts will find a way. But I do not believe that APPLE is obligated to provide its forum to an APP of this nature.

To Steve Jobs – The Manhattan Declaration, is a decree of religious fervor, that APPLE has associated itself with by virtue of its recent approval of an Application that will serve to enhance the spread of anti-gay hate speech.   Various religious right figures and groups are urging, among other things, non-cooperation with laws that in any way recognize same sex couples. It has been condemned in many circles and for good reason. Wayne Besen of Truthwinsout.org said the following: “This is a disturbing call for anarchy from a group of radical clerics and activists who believe they don’t have play by the same rules as other taxpaying Americans.” And according to the blog Instaputz, there is another reason to not only oppose this document but also raise the alarm about it.   Some of the names those signing the declaration aren’t a surprise. They are the usual folks who oppose LGBT equality – Tony Perkins, James Dobson, Maggie Gallagher, Gary Bauer, etc.

Apple is apparently standing by its decision by giving the app a rating of 4+, meaning the company doesn’t consider the material to be offensive.

I have been writing extensively on this topic of corrective rape and was disturbed and sad to receive this e-mail tonight from Ndumie Funda, the activist who under the non-profit banner “Lulekwi Sizwe,”  helps “corrective”  rape victims by housing them in her two room leaking shack in the township of Gugulethu in South Africa.

Just last week we published an email from Ndumie Funda where she pleads for protection for herself and other victims especially for those, like Millicent Gaika who are giving testimony in the trial of accused rapist Andile Ncgosi.   Ms. Funda is a tireless warrior and working with no help at all.  Her letter is heartbreaking.

The South African press has also failed the  victims of this horrendous brutality; we are talking not about a village or a war zone – we are talking high rises and concrete and tourists.   I have called the Press out in South Africa on their failure to take notice of their own citizens -in context of last weeks tragic killing of a British honeymooner killed in a car hijacking.  The latter has had enormous  attention, but endemic rapes, murders and suicides of South African lesbians and other women remain unreported. Victims are left to fend for themselves with no resources whatsoever, and worse yet no protection from perpetrators who continue to live as neighbors of victims and continue to victimize them either psychologically through overt threats or physically again and again and again…..

Yesterday i received another call from Ayanda she said – sis Ndumie my friend killed herself on Monday .  She couldn’t stand watcthing the 4 guys who raped her because she was a lesbian.  Stigma its a problem here and also one of the this Ayanda highlighted to me
is you report the case to the police and do nothing about it no protection.   All Ayanda was asking from is sis Ndumie help my friend
like the other victims – you help and i could because i also need help.

Now i feel bad Bulelwa is no more and i couldn’t help her with my space and advice her how to lay charges. Sorry this is my calling i will fight up until the last drops of my blood. I once lost my partner and a friend not this tme .a months back another lesbian from Nyanga was found dead in area called Delft and her funeral was 2 weeks back and now this shit and the

Zuma is granting these animals bail.

Mel Nathan; Nov 21, 2010; – The San Francisco Redevelopment Agency gave its final nod to the building of a TARGET store in the Metreon; and it took less than a year for what usually can take many.  The building’s landlord, Westfield Metreon, asserts if  all goes well it will be ready in 2012, and  included will be a “visually inviting” 470-seat dining terrace overlooking Yerba Buena Gardens, more outlets, and a 10- to 14-foot-tall sculpture at the corner of Fourth and Howard streets. This marks a first for Target which has downsized for this city center venue;  the usual  175,000 sq ft mega stores are located where rents and land size are more inviting.

A  Target spokesperson  told Dow Jones: “We believe there is a compelling opportunity to open smaller stores of about 60,000 square feet to 100,000 square feet, with a reduced, optimized assortment, when larger sites simply aren’t available” and for  for the Metreon, it’s an opportunity to “transform an underperforming asset into a successful shopping destination … and generate significant economic activity as a result,” according to a Redevelopment Agency memo presented at this week’s meeting.

Had I been on that SF Agency I would have insisted on a guarantee that target money never finds its way into anti-gay coffers again, albeit a clause that would be  unlikely to hold up in a Court  of Law.

To sell the project to the City, Westfield is declaring that an investment of approximately $25 million to $30 million in the necessary changes, will generate an estimated 775 construction jobs and up to 300 permanent jobs with new tenants, other than Target.  Target has said it will  hire up to 250 people. According to the Redevelopment Agency memo, Target is projecting  a minimum of $5.4 million in annual sales taxes, and about $1 million in additional parking revenue for the Fifth and Mission Street Garage.

The big question- is San Francisco selling its soul for some ancillary dollar? Does this set the precedent to evolve deeply into a soul-less commercial magnet?

So what is the brew-ha-ha about these new TSA  X-ray Machines that expose nudity and body organs?  I have noticed two trends in the Gay blogosphere – either zero coverage or pictures of male officers patting down passenger crotches.  It is the straight people that are going crazy over this right to privacy!  Well I have some thoughts on the subject.

Now from what I hear passengers have an option- they have a right to refuse the X-Ray; but then must agree to a pat down. Now unlike straight people gays and lesbians are assured of a pat down by someone of our sexual orientation.   A straight man being pat down may be very uncomfortable when another man fiddles around his junk.  A Straight woman probably would not care that much if another woman gives her a pat down, more I am unsure… but goodness knows if it were the ex-gays or ‘wish-I  knew -I was- a -lesbian’ crew- such as Janet Porter, Christine O’Donnel,  Anne Coulter, Maggie Gallagher – so some may or may not choose to go through X-Ray.

Well I may be the first lez-blogger to say it as it is; hell this is a no-brainer an aging lez like me; why would I choose to be irradiated when I get the opportunity to be sexually molested by a 25 year old, straight woman or lesbian for that matter?  I mean what a choice- and the gay guys- why not  also get a bit of a rise out of travel? Can’t wait for my next flight – can’t come soon enough!

According to LGBT rights group GetEQUAL, six of thirteen arrested protesters will picket tonight’s Common Purpose meeting — an ongoing, low-profile White House outreach effort to liberal activists held at the Capitol Hilton.

Get Equal has issued a statement – “David Smith, Vice President of Policy and Strategy for the Human Rights Campaign, Winnie Stachelberg, Sr. VP for External Affairs for CAP; Rea Carey, Executive Director of the National Gay and Lesbian Task Force, were greeted tonight by the protestors and asked to stand with the LGBT community and not attend the meeting. All three of them chose instead to cross the protest line and enter into the hotel. Smith refused saying, “I’m running late. Also, White House Deputy Chief of Staff Jim Messina was greeted tonight by protestors who chanted to him “Obama, What’s Your Plan?” and “Keep Your Promise!”

It has been fifty-six days since the military was held hostage by John McCain, and sixteen years and three hundred thirty days since Don’t Ask, Don’t Tell went into place.

The change will take place on 1 January, according to the London-based bank. Barclays currently owns Lehman Brothers Holding which they bought in 2008 after the latter went bankrupt. Barclays is not the only company to offer these reimbursements. Google, Cisco Systems, and Kimpton Hotels & Restaurants- all based in California- make these payments. This will make four for-profit companies which do this.

Barclays’ spokesman Mark Lane stated “We are introducing this payment to proactively offset the additional tax. We believe that by offering this, we will further our efforts to promote an inclusive environment.” The reimbursements will be a separate payment instead of an increase in their salary.

Citigroup, Morgan Stanley, and HSBC North America have joined the Human Rights Campaign’s Business Coalition for Benefits Tax Equality while most of these companies have been busy funding the Republican Party which has been dedicated to ensuring that lesbians and gays remain unable to get married throughout the country and continue to be second class citizens.

Same-sex partnered couples pay an average of $1,069 more in federal tax than their counterparts in heterosexual marriages even if they have the same benefits. Employers also pay more costs administratively in order to track the dependent status of covered same-sex partners and spouses because they have to maintain separate payroll functions.

Todd A. Solomon, a partner in the law firm McDermott Will & Emery in Chicago, feels that the reimbursements would increase costs for the employers, but it would likely improve employee retention. He told Bloomberg News “It’s simply to provide equal pay for equal work in this civil rights issue, there’s really no financial incentive. The bottom line is more than how much cash you spend today, it may help the bottom line to be seen as the employer of choice.”

Barclays employs some 88,500 people outside the United Kingdom, as of the end of last year, but no figures are available for how many lesbians and gays they employ.

American activists citing the role of US evangelicals in the anti-gay witch hunt underway in Uganda are calling on the US State Department to immediately offer visas to those ‘outed’ and under threat.

This month  the ‘outing’ of one hundred Ugandan LGBT by a new tabloid newspaper called Rolling Stone (no relation to the veteran American magazine) caused an international sensation. Its Editor Muhame Giles has called for the hanging of gays. It’s publication was swiftly followed by reports of the hounding of those named.

“When my neighbors saw my picture in the paper, they were furious. They threw stones at me while I was in my house. I was so terrified somehow I managed to flee my home to safety.” said Stosh [Programme Coordinator- Kulhas Uganda]

Rolling Stone followed this up yesterday in a new edition headlined “More homos’ faces exposed.” “Men of shame part II,” pictured 14 men identified as the “generals” of the gay movement in Uganda. Muhame told AFP “they published their pictures on a gay networking website, so that was enough evidence for us,” adding that the paper did not try to contact the men before publishing their pictures.

Rolling Stone was last month told not to publish any more issues until it received a license from the Uganda Media Council. Muhame said Monday the paper has not yet received its license but had decided to publish regardless.

“We met all (the council’s) requirements,” Muhame told AFP. “After that, we don’t care what they have to say.”

This is far from the first instance of this happening in Uganda. The tabloid Red Pepper has been doing it for a few years and that has similarly led to the violent harassment of those named and pictured. It happened to the asylum seeker John Bosco, who was returned to Uganda by the British government despite being named and pictured in Red Pepper. He was forced to live underground in Kampala as a result until six months later when a judge, in a unique case, ordered his return.

Ugandan activist Jacqueline Kasha reports that alongside Rolling Stone and Red Pepper another Kampala newspaper ‘Onion’ has now joined in with the ‘outing’ campaign. Kasha and fellow activists David Kato and Patience Onziema have launched an action in Uganda’s High Court this morning suing Rolling Stone for incitement to violence.

When news first reached American ears a year ago about the bill that would make homosexuality illegal and punishable by death, the initial outrage was followed by an investigation into the relationship between prominent American Evangelicals and Ugandan leaders by American news sources. At the beginning of this inquiry, the American media focused upon a conference held in Uganda in March 2009 that addressed, as the Ugandan organizer put it,’”the gay agenda – that whole hidden and dark agenda” – and the threat homosexuals posed to Bible-based values and the traditional African family’ according to this article by the New York Times that was published in January 2010. Many identified this conference as the beginning of the violent anti-gay feeling prevalent across the country. I was eighteen when I landed in Los Angeles International airport. And after a lifetime of being a brown-skinned “curombo,” (“darky”) in Japan, I turned white! Yes.

Suddenly I was no longer a strange brown skinned gaigin (pejorative for foreigner.)

My little brother and I spent our childhood as moving targets for the Japanese boys and giggling girls walking past our house to their school up the hill. I was too busy ducking their cries of  “curombo!” to notice much else.  We lived in Ashiya-gawa, a beautiful suburb with the gawa, the river that ran from the mountain to the sea, both sides of Ashiya river were lined with rows of cherry blossom and maple trees; pink in the spring, bright reds and deep oranges for the fall.

I went back there recently with my brother. We walked from the mountain to the sea (now mostly landfill). No one yells out “curombo” anymore, and foreigners are not a strange sight.  It is very rare however to see any Africans or African Americans anywhere.  I met an African American piano player who had a gig playing a Kobe nightclub. He told me he was the only person of African heritage in Kobe. Despite the changes, despite Japan being a modern country now, its still considered ugly or unfortunate to be a curombo.

At the same time, I saw something I never would have seen growing up there —a billboard advertising Hawaiian tanning lotion!  Japanese sunbathe? I asked in my perfect accent-less Japanese.  Yes, more and more are, like America-jin, like the Americans. Of course, sooner or later we all become Americans…

It’s a long story how my parents got to Japan, so let me just say that we were Stateless Egyptian (dad)/Iraqi(mom), Jews, who ended up in Japan before Egypt canceled dad’s passport (the precursor to the mass expulsion of Egyptian Jews in 1956), making it impossible to conduct a viable import-export business.

Japan was uncomfortable being stuck with stateless foreigners and we were desperately waiting for immigration to the USA.  I turned 18 and graduated high school, still no immigration on the horizon, so my parents put me on an airplane with my visa from the Red Cross to go to college. Lots of crying, lots of separation anxiety, but the litany, “there is no future here for you, you must go, and inshallah, we will follow…” was well embedded in my psyche.

Something happened when I landed at LAX. Something I never imagined. Something so strong and compelling and almost immediate: I tuned white! There were “real” dark people in America. Real “curombos” and a country filled with “gaigin.”

Imagine: a lifetime of being seen as an unattractive “darky,” now magically turned inside out into, “Where did you get your tan”? Gaigin no more, curombo no more. Gone, in a flash, it was all gone.

Overnight, with one plane trip, my curse became “exotic”.  I am not making this up: I spent my high school years with a masque of Clearasil carefully applied on my brown face every single night. I bought it with my allowance at the American Pharmacy, not for acne, but as a masque to lighten the brown. I prayed to my personal God for it to work, I tortured my brother taunting him with “you are darker”!  I feared the devil would come to me and make a deal I couldn’t refuse (I was raised in Catholic missionary schools).  My skin colored every aspect of my being.

Its even hard for me to imagine now: Before Black Liberation, Before the world changed. Before the browning of America.  Before Malcomn X. Before Barack Obama.

So much misery, wiped out by one plane ride.  But I had done my homework before getting to America.  I lost my Indian singsong English dialect by the time I was 8.

I refused to speak Judea-Arabic and yelled at my parents “do not speak to me in that ugly language!” Of course I understood every single word they said.  I studied every American magazine that came my way.  I rejected my Arabic nationality. I was miserable with the skin I lived in, and I lost any trace of a “foreign” accent. I worked hard to lose my identity.

The only thing I did keep because it was the only thing I wasn’t going to lose was being a Jew. I was a Jew, and I defiantly stood up to the nuns. “If Jesus was a Jew, then why do I have to convert”?

So at age eighteen and a half, the nuns are gone, the taunts are gone, and I am in America, in the San Fernando Valley, and except for the occasional “who’s that cute Spic chick?” I was a white Jewish girl with a great tan.

When I asked my mother, so many years later in San Francisco where we settled, “speak to me in Arabic,” she gave it back to me with raised eyebrows, “now you want to learn? Its too late!”

Judeo -Arabic is my mother-language, but my tongue won’t go there. I understand every single word, but I can’t find the words on my own, and when I manage to retrieve a phrase, my accent is so bad, better not open my mouth.

My background remains invisible but I have a great tan. And now, when I am asked, “where did you get your tan?” I tell them: From my father.

Melanie Nathan – October 25-2010 – HRC’s Joe Sainz on MSNBC

Monday, Joe Sainz from The Human Rights Campaign, made a sustained and decent appearance on MSNBC Newsnation – In an interview Sainz referred to the fact that the LGBT community is disappointed in this Administration. He noted that this President has done more for LGBT community than any other in history, but that gays lesbians and transgender people are still denied fundamental rights such as job protection and the right to love the person of their choice.

He urges the gay people to come out and vote Democratic, as the ticker displayed words “we will NOT donate/ but we must vote democratic.

When asked if gays would be voting democrat simply because there is no better choice, Sainz made it clear that the GOP – Republican Party- would be a disaster for LGBT equality and our fundamental rights and that if Dems did not continue to control Congress, we could see a reversal in the progress he asserts has been made.

Indeed there has been some progress – but truly what?   Yes we have a Hate Crimes Act- and the repeal DADT is in a mode it may not otherwise have been in – but yet to be repealed!   Yes we have gained acknowledgment and visibility from this President.  But in truth we are still second class citizens.

My perspective is one of fear – hardly something I admit to very often.   I am afraid that if we allow Republicans to take over – and I do believe we have the power to come out en masse to vote to affect the Congressional stack- then we are truly screwed for six or more years; UAFA will not pass through with Immigration reform, or at all, DOMA is firmly entrenched, DADT will go nowhere, ENDA stays dormant – and all the President will be worth is a veto signature – for the time he has left in the White House.

My fear extends to a vote at all – as I am feeling – what choice DO we have – do we sit at home and say “see I told you – DEMS we could have made an impact but we stayed home; OR do we go out and vote and say look we helped you stay in and now we are begging yet again?  Will any single democrat remember that we showed up on this crucial Nov 2nd date 2010 – when we knock on their door for a Private Bill because there is no equality in immigration and so NO law  where an American Partner  can Petition for green card /immigration for a foreign same-sex spouse?

Well bottom line – indeed we have no choice – we must vote Democratic and we MUST go out and vote and there is one simple reason for that – it takes all complexity out of the decision – the simple fact is we MUST stand up for what is right we  must stand up for social justice – for equality- not voting for a democrat and not volunteering to get out the vote for the next 8 days is tantamount to giving up on what we believe so strongly in. A victory for Republicans endorses their belief that we are nothing more than a wedge issue that works for them.  I will not participate in that mindset by staying home and I I hope I can influence you to feel the same way!

Even though I am ashamed of this Congress and the President’s inability to push us into an equal citizenry, I will do all I can to get out the LGBT and ally Democratic vote – and the reason I am doing it – is as I said simple – we must keep our allies in Congress and we do have allies, we must bolster their numbers, not decrease them and then we must hold their feet to the fire and aggressively seek progressive democrats over the next years, making it very clear that we do have an enormous amount of power and and EQUAL VOTE!

Get out the Vote Queers and note the specific State  Senate Representatives  where failure is political suicide for LGBT rights:-

Add this to Meg Whitman’s closet – oh and also the tax returns that are buried in there too!!

Griffith Rutherford Harsh V – now that’s an unknown name; but it should not have been and nor would it have been had Meg Whitman not been a billionaire who could hush the rape accusation leveled against Griff- her son! He was never arrested or charged with a crime in connection with the alleged sexual assault incident. Princeton dealt with it quietly and internally, ultimately allowing Harsh to continue his education. He graduated with the class of 2009, three years after his rape accusation—and two years after the inauguration of Whitman College, the residential living complex his billionaire mother donated $30 million to help build. The donation was announced in 2002, the year before Griff matriculated.

Now I have heard about parents spending money to get out of the crap – but wow this is a big dollar price to get your kid off the hook. But then again her $30 million equals 3,000 to the pocket of most fortunate Americans, like $30 to the poor…blah.

According to gawker, the accusation was made after an incident on a spring night in 2006, Griff—then a sophomore—went partying as he would later tell a panel of university disciplinarians, he ran into a classmate and went home with her. They had sex. She awoke the next morning with a black eye, bruised face and, she told friends, no memories from the previous night. According to multiple sources—one of whom was a dormitory adviser at the time—the girl told her friends Griff Harsh had raped her.

A friend who spent time with her the next morning spoke to GAWKER under the condition of anonymity, says Gawker: “She woke up with him on top of her, and he was like, ‘You need the morning-after pill.’ And she was like, ‘Why, what happened?’ She didn’t remember having sex, she didn’t remember consenting, she didn’t remember any of it. “She had clearly hurt herself badly. Or been hurt badly.”

The girl consulted her friends, some of whom worried about the “social repercussions” of accusing such a high-profile student of rape. She was “terrified,” according to her friend. “She didn’t want to press charges because it’s Meg Whitman’s son. She didn’t want to go through that. She didn’t go to the police. She didn’t get a rape kit.” But she did go to the campus health clinic the day after the alleged assault. Shortly thereafter, Princeton launched an internal investigation. They did not discipline Griff because they said they did not have enough evidence.

The rape accusation wasn’t Griff’s only illegal behavior. One year later the 20-year-old was arrested in Princeton for buying alcohol with a fake I.D. He pleaded guilty to underage alcohol possession. Charges of lying about his age to buy alcohol and possessing a “false government document” were dismissed. Meg Whitman is not only new to running for office, but new to politics as a non voter from the past. No interest on politics until now? Suspect- Now she credits her late political awakening (she didn’t register to vote until seven years ago) to her busy schedule: She was “focused on raising a family.” (oops irony)  And yet her two adult sons have been absent from her campaign, perhaps because both boys have faced their share of scandals. (Most recently, Griff’s younger brother Will got into an altercation with a Princeton professor.) Meg embarrassed, by her own kids or kids incapable, or  kids no interest.   All not good sign.

Well not such nice nor wholesome people I would say.  Money can never buy honesty, intelligence, compassion, kindness, love or spirituality, but it sure can buy Princeton  and California. Well I hope we can prove the California purchase wrong!

While this month, Equality Across America (EAA), took  a moment on the anniversary of the National Equality March to recognize the 250,000 activists who organized themselves to participate in the historic National Equality March that was fueled by the grassroots and  activists  inspired to take action for full federal equality, the fate of the Organization remained in the balance. Today the TIDES has announced its withdrawal of the non-profit Project support.

The EAA National Organizing Team represented a diverse group of LGBT activists from many groups, cities and experiences across the USA. Their successful regional and citywide conferences across the country drew more than 1,300 LGBT activists and allies helping to win more people to building a national grassroots network and to meet many of these new leaders.

I was a speaker at one of those conferences in Texas.  It was there that I was recruited to a interim advisory board to assist in deciding the leadership, organizational plan and future of Equality Across America. The fate of EAA has been hanging in the balance for sometime, as the Tides Project its Non- profit “administrative sponsor” has been trying to effect a leadership and organizational plan with Board and the interim advisory board of LGBT leaders.

I never reported on the many and e-mails that took place as I was one who really wanted to give EAA a chance to pull together and yield some form of unity in its leadership.  But now that a conclusion has been reached, the information can be made public.  It became clear that there were many differing Agendas and “needs to be heard” that unfortunately caused the astute and very supportive Tides Group to revisit their sponsorship.  They needed leadership, a plan and there was none forthcoming. I commend Tides for really working hard with the group and providing a great amount of time to come through.

Yesterday the Tides informed the few us who remained engaged “We believe that we engaged all interested parties to determine the final resolution of EAA, through conference calls, several follow-up calls and emails with those who continued to show interest, from members of the ENOT board and from some previous board members.  As you know, EAA came to Tides as a march and after that was completed, the future focus became unclear.  Tides waited for clarity and leadership to evolve, encouraged collaboration among those remaining interested, and finally, based on the information we gathered, concluded that there wasn’t sufficient collective leadership or a clear mission focus.”

The amount of $70,000 (approximate) remained in the coffers for EAA and the remaining work involved deciding how to distribute those funds amongst similar or related interest groups or projects.

Tides came to a final decision regarding the distribution of the remaining Equality Across America project funding.

Here is the Final Report:

After review of all communications and proposals, we have arrived at what we believe to be a well-balanced solution. We will be splitting the remaining funds evenly between the three organizations below, each one working to support LGBT rights.  We selected an organization that recognizes young leaders, one that seeks to effect change through advocacy, and a third that concentrates on research and a public education campaign to eliminate the causes of social stigma against LGBT children and adults.

COLIN HIGGINS COURAGE AWARDS

Unlike scholarship opportunities available to youth based on grade point averages or written essays, Colin Higgins Foundation looks to communities across the country to nominate and lift up the LGBTQ youth leaders who inspire them and play critical roles in their schools, organizations, and community spaces. Championing the leadership of LGBTQ youth independent of scholastic achievement is especially important when there are so many barriers standing in the way of their success, from schools that compromise their safety and well-being on a daily basis, to the alarming number of youth who get kicked out of their homes and become homeless due to their sexual orientation and/or gender identity.  Acknowledging these barriers, the model of requesting nominations from communities for youth to be considered for a Courage Award has enabled the organization to meet its goal of prioritizing historically under-served constituencies within the LGBTQ movement including youth of color, low-income youth, and transgender youth.  Youth Courage Award recipients receive a grant of $10,000 and will be honored at The Trevor Project Gala in New York City. The Trevor Project operates the nation’s only 24/7 suicide and crisis prevention helpline for gay and questioning youth. The awardees will also receive a scholarship to attend the National Conference on LGBT Equality: Creating Change presented by the National Gay and Lesbian Taskforce in February.

GET EQUAL

GetEQUAL  works to empower the lesbian, gay, bisexual, transgender, and queer (LGBTQ) community and allies to take bold action to demand full legal and social equality, and to hold accountable those who stand in the way. They envision a society in which LGBTQ people experience equal protection under the law, and are free from cultural and social transphobia/homophobia, without caveat or compromise. To that end, GetEQUAL will inspire and equip the LGBTQ community and allies to fight back against discrimination in a way that builds power and personal agency, encourage LGBTQ people to take our place to push forward progressive change as equals, and to build bridges with all who struggle for justice and dignity in their lives.

FACE VALUE
Because focusing solely on winning political rights has not led to social equality for LGBT people, the mission of the Face Value Campaign is to eliminate the persistent social stigma against LGBT children and adults by applying thoughtful research methods, traditional and new campaign tools, and collaborative organizing techniques to a deliberate public education campaign that takes place outside the narrow time-lines of electoral cycles and the narrow focus of specific LGBT issues.

In its final comment TIDES indicated that this indeed was no easy task and that it required a great amount of thought, input and effort from different realms of the LGBT leadership: “This has been a very complex and difficult process, and we want to thank those who helped in the process for the time and effort spent providing us with background information, your ideas, and your concerns.  We wish you all continued success as leaders in the field of LGBT rights.”

I would like to add that  TIDES is an amazing resource for LGBT groups and individuals and has provided extraordinary support for a myriad of LGBT and related Progressive Projects.  It was a privilege and a pleasure to work with their very professional staff.

This election season outside interest groups are pouring money into campaigns, like never before.  From one State to another, groups that may serve a State with a conservative slant intend a prop-8esque-takeover-of foreign thought and ideal, impinging on the organic voice of the target liberal State, robbing it of the purity, once envisioned by democracy.

So we are robbed of our collective ideals as NOM bus rolls through California chanting CARLY and having the Chutzpah to paint my liberal street and with her signs, which by the way, here in Woodacre, looks like the local propane company’s sign.  This attempt to hijack my thought and belief on my turf is crude and unscrupulous – whereas if donations had some form  of territorial balance – my California would be untouchable by the Maggie Gallagher and her ilk- who have yet to pay a dime in tax here and who have no right to buy my seat on the Hill.

Well guess what some of us are not taking it lying down.  Already the complaints to the Federal Election Commission and the Internal Revenue Service are revving up.

Thursday, two gay rights organizations, the Human Rights Campaign and the Courage Campaign, will file an IRS complaint over the tax status of one of their most vocal opponents.

The groups allege that the Ruth Institute, an arm of the National Organization for Marriage, has violated rules forbidding charities to get involved in political races. NOM, which opposes legalizing same-sex marriage, denies the allegation.

The complaint, a copy of which was provided to The Washington Post, our source, “points to evidence that the president of the Ruth Institute, Jennifer Roback Morse, has actively participated in events in favor of Carly Fiorina, the Republican candidate for Senate in California.”

The Ruth Institute has also actively campaigned for judicial candidates in that state’s San Diego County and in Iowa, where conservative activists are leading an effort to remove three state Supreme Court judges who voted in favor of marriage rights for gays there, according to the complaint.

“The evidence that the Ruth Institute and the NOM Education Fund repeatedly stepped over the line into illegal activity is indisputable,” said Joe Solmonese, the HRC’s president. “Is the Ruth Institute nothing more than a front and funnel for NOM’s political activities?”  According to the Washington Post  report.

NOM President Brian Brown denied the allegations.

On Wednesday, for example, the watchdog groups Public Citizen and Protect Our Elections filed a complaint with the FEC alleging that the pro-Republican organization Crossroads GPS is violating federal campaign finance laws by claiming to be a nonprofit group rather than a political committee. A similar complaint was filed with the IRS earlier this month against Crossroads GPS, which was founded with the help of GOP political guru Karl Rove and is one of the leading spenders this year.

According to the complaint, the Ruth Institute is listed as a project of NOM’s Education Fund, which is incorporated as a 501(c)3 nonprofit group, named for the portion of the tax code used for charities. Donations to such charities are tax-deductible, but the groups are prohibited from participating in political campaigns.

NOM has spent more than $200,000 in an attempt to unseat Sen. Barbara Boxer (D-Calif.), but the Ruth Institute is supposed to steer clear of those efforts.

With no regard for the law, “the Ruth Institute has violated that prohibition in several ways, according to HRC and Courage Campaign. In one example, a video shows Morse at a Fiorina campaign event in San Diego, where she identified herself as the Ruth Institute president, handed out bumper stickers for the institute and urged listeners to visit the group’s Web site. The complaint also cites other videos, Internet links and blog postings linking the Ruth Institute with the Fiorina campaign; many of the references have since been removed.”

Neither side expects the matter to be decided before the Nov. 2 elections. The IRS can take months, or years, to adjudicate such complaints.

Two female employees of Dallas Fire-Rescue filed suit last month agianst DFR, alleging ongoing sexual harassment and discrimination. The lawsuit filed by a former DFR maintenance worker  and a current firefighter is just the latest in a string of such lawsuits and allegations of misconduct dating back to 2006, according to this story by WFAA.com.

One worked for 21 years with Dallas Fire-Rescue in the department’s maintenance office. She alleges that she found semen in her coffee cup and smeared on her desk — including on her daughter’s photo.  The other still works as a firefighter for the city. She said she would often find personal items destroyed and once discovered someone had urinated on the rug near her bed. She was transferred to another fire station.

The lawsuit alleges, the women who complained, were demoted or fired.

Leanne Siri, the highest-ranking woman at Dallas Fire-Rescue, was fired in August 2009 — months after she sued the city for sexual harassment.

The city insists her termination was not related to the lawsuit, but Siri’s attorney, Amy Davis, believes more women who want to come forward are afraid of retaliation.  “I believe there are many, many other women who are victims of the same sort of conduct,” she said.

Now a group of activists in the LGBT community are stepping up to stand behind the female firefighters: Get Equal Now is planning a “Ribbons and Roses” rally and candlelight vigil for Sunday, Oct. 17, at 7:30 p.m. in front of Dallas City Hall. And to raise money to pay for the rally, some women will become “kings” when they stage the “King for A Night” drag king fundraising show on Friday, Oct. 15, at 10 p.m. at The Brick.

The show will star C.D. “Jaime Fauxx” Kirven, Elizabeth “Julian” Pax, AB aka Twisher, Laura R. aka Prynce, and more. And if you want to be one of the “more,” just e-mail Kirven at cdkirven@aol.com by Tuesday, Oct. 5.

What I always marveled at about Republicans is the fact that they stick together regardless of Common sense.  Someone like Palin can make the most asinine remark and it is as if someone tickled the microphone with a feather!

What about it Democrats?  Is the schism in the base – the core – the voter gap?   Who are you trying to please Democratic Senators and those of you in the House?  How do the moderate Democrats get to participate in the hostage takeover of the National Defense Authorization Bill and hence DADT.    How could Reid include DREAM ACT and not UAFA?  Swirling questions and anger abounds. ..

As far as the Gay, Lesbian and all LGBT community is concerned we have derived nothing out of Congress since President Obama and Nancy Pelosi have been at the helm, with a majority compliment in both houses.  We are the ones with nothing to lose. While we are steeped in court victories -we are teetering on the verge of nothing from this administration and Congress.

The Democrats MUST get DADT through next week.  If they do not – then the Gay and Lesbian community will be called upon to retract all support of all democratic candidates in congress. This is an open threat.   Repeat – This is a threat!

You will note from prior posts that I am an avid supporter of the democratic party.  I invite you to read all my supportive posts of democratic candidates.  I have begged our community for support when they have threatened to with hold their dollar support in the past. I have called it counter-productive. But now if DADT fails I am on that bandwagon as is Lez Get Real.

Our blog site has a monthly readership of hundreds of thousands and we are followed and picked up by many of the LGBT bloggers. We comprise a group of people and bloggers who reach millions of people including LGBT people and when we put something out it spreads like wildfire.

Unless DADT is repealed in next week’s vote then the Democratic Senators can expect all gay and lesbian and LGBT support to be pulled. The logic as seemingly ill founded is there.  Years from now, things will be so bad for everyone that maybe, just maybe, we will stand a chance of people electing progressives to Congress.

I ask you Queers and friends what do we have to lose?

I am not asking Americans what they have to lose- America has a lot to lose – we all know that. We the LGBT community is not ‘America’ – we are second class citizens.  Until we are all equal and until our servicemember brothers and sisters can serve openly and proudly in the military, we have nothing to lose and must operate reactively as a result.

Remember apartheid in the 49’s to 90’s and how it came down in South Africa?  It was the oppressed who were prepared to go through economic hell- which they did – and then succeeded in bringing the Afrikaner government to its knees – and so hailed the end of apartheid.  Well as a lesbian suffering prejudice and inequality and watching the suffering of my fellow Americans, we will call out to all to boycott the Democrats until they place the right thing before Politics.

We are so over Political ‘pawnship’ of our rights; over being told to wait; asked to sneak  every aspect of our lives through  back doors.

It is enough and friends next week is IT! This is a call to democrats to understand we mean business- DADT must be repealed and this is the ultimate test of your representation.   When one moderate representative traitors this Repeal – you will be taking down all the Democrats and your statement will be that you do not care about our service members who are gay and lesbian. That will speak to our LGBT community in a VERY large way and I guarantee you we will make so much noise your career will be over anyway.  Weigh that up against the fact that most Americans and servicemembers support DADT repeal.

So  these are the Senators that must be put on notice whether up for re-election or not:
Senator Nelson (FL),   Senator Webb (VA) , Senator Lincoln  (A), Ike Skelton ( MO) and others.

1. All Democratic Senators must vote yes;
2. Democratic Senators must make efforts to reach out to the others who say no or who are teetering – whether Dem or Republican.

We are watching you and you are all accountable.

Will it take the O’Donnels, Palins, Bachmans, and Angles to be seated for some years, to wield their craziness before America realizes that this is not politics as usual.  That we are willing to sacrifice ourselves to the likes of these wicked witches so that we can ultimately elect progressives- because that is what I believe this synchronicity is all about?

So in sum:-

No, Senators- for me this is not business and politics as usual and here is why:-

a. You have failed the Gay community and DADT repeal next week is your only redemption

b. We the gay community have nothing to lose- why? Because we will have seen the ultimate Congressional sitting come and go… the one we perceive as having had the power and clout to get us some legislation; we believe we may well have to wait the passing of an entire generation – because the next one has no problem with equality.

So now I have spewed what is on my mind. Tonight I will say Kol Nidre to start my atonement as a Jew and I will be asking for forgiveness on this Yom Kippur- for all of my own indiscretions – some of which may well be contained in this post.

However I have faith in G-d that somehow the “right thing” is not so much about business as usual and political maneuvering s in the name of self interest, but more about kindness, compassion, love and parity for all in every aspect of life.

So as mere messenger I believe some of us are indeed charged with a voice that others may not like – this is the extent to which my good conscience has been willing to go a risky one yes;  – yes out on a limb, again – I will go toward the gates “Neilah” tomorrow evening and hope that I am inscribed for another year into the book of life.

This is my wish too for my family and friends – may you all fast well.

Kelly Ayotte  served her home state of New Hampshire for five years as its first female Attorney General where she earned a reputation as a tough on crime prosecutor.  While Ayotte was serving as the state’s top law enforcement officer, New Hampshire remained one of the safest states in the Nation. On July 17, 2009 Ayotte stepped down as Attorney General to run for the United States Senate to replace retiring Senator Judd Gregg, so her website touts and that may be well. But what kind of women denies other fellow American Mother’s the privilege of freedom to adopt.   (‘Not to forget Father’s.’)

That said, take a second look at the Ads on her site and tell me what you think. To me they do not look like real organizations but made up ads of feigned coalitions.  I am not going to take the time to look further- but invite my good friends in NH to do the work.  If I am right about this -then her campaign is a dishonest one and she should be exposed. It may seem that I am lashing out at her for her statement made on the debate tonight; however I am suspect of any mother who can disregard the parenting of other women without taken the time or trouble to visit and befriend families such as mine.

If there is a claim to ownership of  the civil rights movement can we please stake our claim?  Today is the anniversary of the ‘I have a Dream Speech’ -Dr. Martin Luther King Jr. at the Lincoln memorial and it will always be  remembered! Nothing can change what it was about or who it was for and yet in many ways all of us own it.

It belongs to America and American history.

However some say its been hijacked and others say its their domain… “They want to disgrace this day this is our day and we will not give it to them.” Says Sharpton of Beck! and We want to reclaim honor in America says Beck as he trespasses the turf on this day – impeaching the way!

No one group’s struggle can be measured against that of another; yet according to Glenn Beck it can and he is the victim!  Now that slavery is done the “I have a Dream” moment belongs to King Beck?  Or is it Beck the Messiah claiming the Jesus domain?

You may have noticed that LezGetReal has barely given – if any – time to Sarah Palin and Glenn Beck and their Rewriting History Rally.   But now we must, in sharp contrast, give credence to Rev.  Al Sharpton and the crowd of diverse thousands who may seem to have stood in counter to Beck who may have stood in counter to Sharpton – ok – it can be confusing. But if you are queer it ought not be. It ought to be damn clear!

In truth there is only ONE Civil Rights movement – the only one that can ever be – and it must remain all inclusive and as Sharpton noted – it belongs to no ONE group but to everyone.  It belongs to America and it is an ongoing quest – for as long as there is any one group that is the subject of  flagrant discrimination via legislation.

DOMA (The Defense of marriage Act) is the perfect example of  legislated discrimination – as is the Don’t Ask Don’t tell Policy (DADT)

This week I watched Keith Olberman on the subject of Beck and also delighted in 2 Comedy Central pieces, by Jon Steward and Steven Colbert, respectively, on the topic of some omni-power-messianic idea orchestrated by Beck – that he is going to fill the shoes of “Dr. Martin Luther King Jr. at the place of the I have a Dream Speech” and take back a rotten sordid America!  Back from whom – for whom?

Well allow us to inform  Mr. Glenn Beck – the only group without civil rights in this Country are us the Gay Lesbian (LGBTQI) people in the USA.

The rest who acquired such rights under the 1964 Civil Rights Act are now Beck’s victims -  not the other way around as Beck tacitly imposes on the people he incites to hate – to  perpetuate the racism that the Civil Rights Act did not cure – the hate that remains in the hearts of those who listen to  beck, et al!

Beck is no victim- he just cannot not fit that mold.

Now the only overt leadership in this country that recognizes the LGBT plight as a civil rights issue and has had the courage to make the statement – is the African American leadership.  Rev. Al Sharpton said today on CNN that   LGBT equality is a civil rights issue. Julian Bond has stated the point in many speeches including in the Senate Judiciary Committee hearing for UAFA.

Now while we know racism is at an all time high in this Country, all this “we have a DREAM ownership claims” – is a slap in the face to all good Americans who see it in its totality – in its historic context and as a vortex for unity and the  future of equality for all.

The only dream yet to be attained in this country, (besides the de facto riddance of racism and hate,)   in so far as the LAW (de Jure)  is concerned, is the dream as dreamed by same-sex and LGBT populace; LGBT people and their families,  - to marry, to sponsor for immigration, to adopt, to serve, to work, to be included  and protected fully under the federal  law of the USA – ultimately an amendment to the Civil Rights Act, of 1964 that includes Sexual Orientation and Gender identity.

Thanks for your support to the American Equality Bill – and the Amendment of  the Civil Rights Act of 1964 to include Sexual orientation and Gender Identity. The Omnibus for all LGBT Equality legislation.

Curve Magazine has recently announced by way of Facebook that without financial assistance from the public, they may not make it to its 21st anniversary issue. As unfortunate as that is, my check won’t be in the mail.

Curve Magazine has prompted an eye roll from me for many years. Every time I come across that magazine, I open it up to see if my ongoing criticism of there not being any women of color in it are still true. Each time I checked, I put the magazine down with another eye roll because true to form, there weren’t. My queer women of color music festival, Serafemme, got a passing mention in 2008 because 7 time Grammy nominated singer/songwriter Natalie Stewart performed; however, celebrity has often been Curve’s criteria for women of color getting so much as a passing mention and any qwoc affilitations she had got print by riding her coattail so to speak.

I understand that people by nature gravitate towards anything that shares the same characteristics they do so I don’t have a problem with the fact that Curve is a predominately white magazine. I don’t need for my media to be 100% of color to support it but even in reviewing their website – www.curvemag.com – there are very few of-color mentions on a site with over 50 pages – one article on why African-American women find it difficult to come out, a picture before the forums section of a woman who looks a bit Asian and a picture of the Slits which includes one African American member. I don’t count the two Black Pride event listings because those are user-submitted events that the magazine had nothing to do with promoting.

As someone who is committed to highlighting and protecting bisexual and lesbian-safe spaces, I should be “fighting the good fight” for Curve,I suppose. I should be blogging about their plight and encouraging others to contribute. I guess that would be the thing to do if all that mattered to me was that they were lesbian-oriented but I’m not that superficial. I support anything that is lesbian-oriented and inclusive. Curve is not. In fact, Curve supports my criticism that not enough media that outreaches to the queer of color community and I count Curve as one of the reasons why I felt compelled to start my own magazine last year.

It’s important to note, I’m not happy about Curve’s financial woes. In the grand scheme of things, a lesbian magazine is necessary and needed in order to inform, educate and empower women who have such little media directed to them as it is, I only wish Curve would have realized that that was true for me as a Black woman as well. I will not be making a contribution because Curve didn’t make enough contribution to me or the of-color community as a whole. I wish them well but any help they get will not come from me. Should they pull through and continue with the magazine, I hope they do it with a new mindset – one that highlights every racial spectrum of our gay rainbow. In doing that, they will find an explosion of provocative content, people and events to highlight and they’d find me as one of their biggest supports.

For several years, The Home Depot has given its financial and corporate support to open displays of homosexual activism on main streets in America’s towns. And, it says it will continue to do so!

“At the end of the day here, we’re not going to…forbid our associates to be involved in these pride festivals in any way.” – Stephen Holmes, company spokesman. (Note: The associates participating in these parades were clearly doing so as representatives of the company.)

Rejecting several requests by AFA to remain neutral in the culture war, The Home Depot has chosen to sponsor and participate in numerous gay pride parades and festivals. Most grievous is The Home Depot’s deliberately exposing small children to lascivious displays of sexual conduct by homosexuals and cross-dressers, which are a common occurrence at these events.

The goal of every homosexual organization supported by The Home Depot is to get homosexual marriage legalized. BoycottTheHomeDepot provides just a glimpse of how broad its support for the homosexual movement is. The Home Depot says it is committed to furthering the homosexual agenda.

“The bottom line is, it (remaining neutral) just runs counter to our inclusive culture…and that’s where we stand.” - Stephen Holmes, company spokesman.

According to Out Now CEO Ian Johnson “After ‘coming out’, LGBT people in 2010 are now well advanced in the process of ‘coming in’ – into the mainstream of society in many ways. . .There still exists levels of discrimination and misinformation directed against LGBT people – but this new research reveals a clear trend. Gay consumers switch brands to support companies that support LGBT customers and staff. This is highly significant – and valuable. . .The research shows marketing to gay consumers, and supporting LGBT staff, can add valuable percentage points to total market share – and profits – for companies developing effective, relevant and authentic strategies.”

Consumers who support LGBT supportive businesses account for roughly six percent of all worldwide sales. Out Now Global is an LGBT marketing specialist agency. It currently has research underway in twenty countries in North and South America and Europe.

When it come to immigration reform,  the people who count first on this topic, to my way of thinking, are those who under current law are not treated equally, yet President Obama has seemingly provided the visual for the year long covert alliance-making between the various religious groups and the Administration, some Politicians/ Senators such as  Chuck Schumer,  Congress Flip-Flop Gutierrez, which reflects a myriad of alliances, which in my estimation points to an attack, not only on the LGBT quest for equality, under current immigration law, but also on our factual existence as couples with a right to happily call our American Country, home!

“Normally on the opposite side of political issues backed by the Obama White House, leaders are aligning with the President to support an overhaul that would include some path to legalization for illegal immigrants already here. They are preaching from pulpits, conducting conference calls with pastors and testifying in Washington — as they did last Wednesday,” reports Laurie Goodstein for the New York Times.

Noticeably at the end of the New York Times Piece is a little reference to the BIG caveat

Others –  and you all know who you are have rarely done more than serve as parrot or space for the likes of Immigration Equality’s- (self professed as the Pre-eminent Immigration equality organization) life altering mistake and insincerity.  Pam’s Blend houses Steve Ralls, of Immigration Equality,  and she has never questioned his or IE’s strategy of shooting us in the heart and soul of UAFA as a stand alone, by trying to run after those who we know hate us. That group has spent your money making alliances with those who are stabbing us in the back as we speak!

This report from the New York Times endorsed my fear and validates my advice to Immigration Equality one year ago, NCLR since and other groups, NOT to endorse or follow the dangle of ‘Comprehensive Immigration Reform” carrot, but to rather keep the Uniting American Families ACT as a stand-alone Bill with EQUALITY the issues as opposed to jumping in on what was bound to be a huge immigration controversy immigration option for same-sex couples denied immigration parity under the Immigration and Naturalization Act.

But some evangelical leaders said their latest strategy was to push a handful of lame-duck Republicans to join Democrats — probably after the midterms — to pass an immigration bill on the ground that it is morally right.

Although other religious leaders have long favored immigration overhaul — including Roman Catholics, mainline Protestants, Jews and Muslims — the evangelicals are crucial because they have the relationships and the pull with Republicans.

“My message to Republican leaders,” said the Rev. Samuel Rodriguez, the president of the evangelical National Hispanic Christian Leadership Conference and one of the leaders who engaged his non-Hispanic peers, “is if you’re anti-immigration reform, you’re anti-Latino, and if you’re anti-Latino, you are anti-Christian church in America, and you are anti-evangelical.”

Evangelicals at the grass-roots level are divided on immigration, just as the nation is. But among the leaders, recent interviews suggest that those in favor of an immigration overhaul are far more vocal and more organized than those who oppose it, as long as the queers are out! Of course!

Their presence was a testament, in part, to the work of politically active Hispanic evangelical pastors, who have forged friendships with non-Hispanic pastors in recent years while working in coalitions to oppose abortion and same-sex marriage. The Hispanics made a concerted effort to convince their brethren that immigration reform should be a moral and practical priority.  Hispanic storefront churches are popping up in strip malls, and Spanish-speaking congregations are renting space in other churches. Some pastors, like Mr. Hybels, lead churches that include

Congress is unlikely to pass an immigration law this year. Republicans and Democrats who face re-election in November are skittish about the issue, given the broad public support for Arizona’s new law aiming to crack down on illegal immigration. The Article insulting to say the least – as is every single piece that is written that fails to acknowledge the importance of our LGBT bi-national plight.

Sabato, director of the Center for Politics at the University of Virginia. “Support for the Arizona law is so strong within the G.O.P. that it will be difficult for the comprehensive-immigration-reform evangelicals to have much short-term impact.”

The support of evangelical leaders is not yet enough to change the mess of the mass. But they could mobilize a potentially large constituency of religious conservatives, an important part of the Republican base better known for lobbying against abortion and same-sex marriage. They already threaten the party’s near unity on immigration. “

So while they mobilize and align for support, we the LGBT community become the scapegoat, as I predicted in my Article in mid 2009, which I shall reference here again.   Again I cannot scream loud enough we need a movement not three career boost seekers making political moves for an huge politically marginalized  group such as the bi-national gay and lesbian community.

All hope that is there is gone unless we get an , a special visa, repeal of DOMA, UAFA as a stand-alone – or an Amendment to the Civil Rights Act.   But alas I fear these mere benchmarks fail to serve the immediate needs of those living the hellish life of a gay or lesbian bi-national.

So all I can think of is an Executive order –

Dear President Obama:

I am so angry and I cannot express it without a SCREAM such as the one above! I am so tired, so tired. I ask one question of you Mr. President.  How can you continue to condone the separation of LGBT families through inequality under the Immigration and Naturalization Act?

It is one thing that we cannot marry and I know you campaigned against Gay Marriage per se; but Sir,when you told us we deserved equality and we worked crazily for your election, and voted accordingly, was it you intention to keep Americans exiled from their own countries and from their partners, whom they would marry if the could?

Mr. President, Sir – please if all you do is make one executive order for us – let it be simply to allow gays and lesbians who are in permanent partnerships with some form of contractual nexus to be included in the current Immigration and Equality Act.

Drafted by Karen Doering, an attorney who has been involved in some of the most important legal LGBT victories and controversies, the American Equality  Bill takes the approach that piecemeal bills for various areas of discrimination be supported through recognition of our civil rights, first and foremost and may serve to yield an omnibus bill that will in essence get rid of all discriminatory legislation.  This is the first  Publication of the Draft is forthcoming.

It also recognizes that creating separate bills in separate areas breaks the interests of those against discrimination into small, separate pieces that dilutes the strong force of the coalition necessary to pass any bill on the federal level.

This is a critical approach to win Equality. Equality cannot come to fruition without the Benchmark – something specific that carries forth a universal message.  Now that we have the wording and the Goal- we need the BILL.

Who ever says this is “Pie in the Sky or Bold” (Bilerco) – is marginalizing our entitlement and our rights.  To my way of thinking anyone who suggest we keep the backdoor approach as our only approach does not have our absolute interests at heart.  Selfless advocacy means going for the only benchmark that will bring full equality, and if we are going to have a movement then we need to have the movement regardless of how many votes we may or may not get in Congress.  They need to know that we are not fighting for legislation; we are fighting for our lives and to live our lives, happily,  like other Americans, and that means equally.    I for one, have a right to enter through the front door -  and that is why I have touted this plan for all this time.

THE AMERICAN EQUALITY BILL

SUMMARY OF PROPOSED CHANGES TO EXISTING LEGISLATION
TO END LEGAL DISCRIMINATION IN AMERICA ON THE BASIS OF SEXUAL ORIENTATION AND GENDER IDENTITY

A. EMPLOYMENT DISCRIMINATION.

SECTION 1. Amends Title VII the Civil Rights Act of 1964, to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in employment.

SECTION 2. Amends the Civil Service Reform Act of 1978, the Government Employee Rights Act of 1991, the Congressional Accountability Act of 1995, and 3 U.S.C. 411 (a)(1), to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in employment.

SECTION 3. Amends the Government Employee Rights Act of 1991, 42 U.S.C. §2000e-16a et seq., to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in employment.

SECTION 4. Amends the Family and Medical Leave Act of 1993 to clarify the definitions of “parent” and “son or daughter.”

B. HOUSING DISCRIMINATION.

SECTION 5. Amends the Title VIII of the Civil Rights Act of 1968 (Fair Housing Act) to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in the sale or rental of housing, real estate related transactions, and the provision of brokerage services.

C. DISCRIMINATION IN PLACES OF PUBLIC ACCOMMODATION.

SECTION 6. Amends Title II of the Civil Rights Act of 1964 to add “sexual orientation” and “gender identity” as prohibited bases for discrimination or segregation in places of public accommodation.

D. DISCRIMINATION IN THE USE OF PUBLIC FACILITIES.

SECTION 7. Amends §2000b of the Civil Rights Act of 1964 to add “sexual orientation” and “gender identity” as prohibited bases for denial of equal use of public facilities.

E. DISCRIMINATION IN ACCESS TO CREDIT.

SECTION 8. Amends the Equal Credit Opportunity Act of 1974 to add “sexual orientation” and “gender identity” as prohibited basis for discrimination in any aspect of a credit transaction.

F. DISCRIMINATION IN FEDERALLY FUNDED PROGRAMS OR ACTIVITIES.

SECTION 9. Amends Title VI of the Civil Rights Act of 1964 to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in federally funded programs or activities and adding an exemption for religious organizations.

G. DISCRIMINATION AGAINST PEOPLE WITH DISABILITIES.

SECTION 10. Amends the Americans with Disabilities Act to repeal discriminatory provisions.

THE AMERICAN EQUALITY BILL
(Scope and content only. This is not in filing format.)

SHORT TITLE.
Upon passage, this bill may be cited as the `The American Equality Act of 2010’.

PURPOSE.
The purpose of this Act is to realize the American ideal of equal protection under the law by amending existing civil rights legislation to include protections based on sexual orientation and gender identity.

FINDINGS OF LEGISLATIVE FACT.
(This will be an elaborate section that details the discrimination against LGBT people. Content TBD.)

A. EMPLOYMENT DISCRIMINATION.

SECTION. 1. Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e, is amended to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in employment, as follows:

a. The following definitions shall be added at the end of §2000e:

(o) The term “sexual orientation” means homosexuality, heterosexuality, or bisexuality.

(p) The term “gender identity” means the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, with or without regard to the individual’s designated sex at birth.

b. Sections 2000e-2(a)-(d), §2000e-2(h), §2000e-2(j), §2000e-2(l), §2000e-2(m), §2000e-3(b), 2000e(g)(2)(A), §2000e-16(a), and §2000e-16(c), are amended every time the phrase “race, color, religion, sex, or national origin” appears to include after the word “sex” the following words:- “sexual orientation, gender identity,”

c. Dress and Grooming Standards. Nothing shall prohibit an employer from requiring an employee, during the employee’s hours at work, to adhere to reasonable dress or grooming standards not prohibited by other provisions of Federal, State, or local law, provided that the employer permits any employee who has undergone gender transition prior to the time of employment, and any employee who has notified the employer that the employee has undergone or is undergoing gender transition after the time of employment, to adhere to the same dress or grooming standards for the gender to which the employee has transitioned or is transitioning.

d. Certain Shared Facilities. Nothing shall be construed to establish an unlawful employment practice based on actual or perceived gender identity due to the denial of access to shared shower or dressing facilities in which being seen fully unclothed is unavoidable, provided that the employer provides reasonable access to adequate facilities that are not inconsistent with the employee’s gender identity as established with the employer at the time of employment or upon notification to the employer that the employee has undergone or is undergoing gender transition, whichever is later.

SECTION 2. The Civil Service Reform Act of 1978, as amended, 5 U.S.C. §2302; Government Employee Rights Act of 1991, 42 U.S.C. 2000e-16a et seq.; Congressional Accountability Act of 1995, 2 U.S.C. 1301 et seq.; and Section 411(a) (1) of Title 3 of the United States Code are amended to specify that “sexual orientation” and “gender identity” are prohibited bases for discrimination, as follows:

a. The terms “sexual orientation” and “gender identity” are defined as in Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e.

SECTION 3. The Government Employee Rights Act of 1991, 42 U.S.C. §2000e-16a et seq., is amended to add “sexual orientation” and “gender identity” as prohibited bases for discrimination, as follows:

a. The terms “sexual orientation” and “gender identity” are defined as in Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e.

b. Section 2000e-16a(b) is here by amended every time the phrase “race, color, religion, sex, national origin, age, or disability” occurs by inserting after the word “sex” the following words:- “sexual orientation, gender identity,”

c. Certain Shared Facilities. Nothing shall be construed to establish an unlawful employment practice based on actual or perceived gender identity due to the denial of access to shared shower or dressing facilities in which being seen fully unclothed is unavoidable, provided that the employer provides reasonable access to adequate facilities that are not inconsistent with the employee’s gender identity as established with the employer at the time of employment or upon notification to the employer that the employee has undergone or is undergoing gender transition, whichever is later.

SECTION 4. The Family and Medical Leave Act of 1993, as amended, 29 U.S.C. §2611, is amended to clarify the following definitions:

(7) Parent. The term “parent” means the biological parent of an employee or an individual who stood in loco parentis to an employee when the employee was a son or daughter. For purposes of this statute, the term “in loco parentis” includes but is not limited to an individual who is a defacto or psychological parent of the child.

(12) Son or daughter. The term “son or daughter” means a biological, adopted, or foster child, a stepchild, a legal ward, or a child of a person standing in loco parentis, a child registered as a “dependent” or similar classification under the employer’s domestic partnership policy, or a child designated by an employee and his or her domestic partner as a “dependent” or similar classification pursuant to a municipal, state or federal domestic partnership registry, who is—

(A) under 18 years of age; or

(B) 18 years of age or older and incapable of self-care because of a mental or physical disability.

(13) Spouse – The term “spouse” means a husband or wife, as the case may be. For purposes of this statute, the term “spouse” includes a person designated a domestic partner under the employer’s domestic partnership policy, an employee’s civil union partner, a spouse from a domestic or foreign marriage, and a domestic partner registered pursuant to a municipal, state or federal law.

b. Sections 3604(a)-(b) are amended every time the phrase “race, color, religion, sex, familial status, or national origin” appears by inserting after the word “sex” the following words: “sexual orientation, or gender identity,”

c. Sections 3604(c)-(e), 3605(a), and 3606 are amended every time the phrase “race, color, religion, sex, handicap, familial status, or national origin” appears by inserting after the word “sex” the following words: “sexual orientation, or gender identity,”

d. Section 3605(c) is amended every time the phrase “race, color, religion, national origin, sex, handicap, or familial status” appears by inserting after the word “sex” the following words:- “sexual orientation, or gender identity,”

C. DISCRIMINATION IN PLACES OF PUBLIC ACCOMMODATION.

SECTION 6. Title II of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000a et seq., is amended to add “sexual orientation” and “gender identity” as prohibited bases for discrimination or segregation in places of public accommodation.

D. DISCRIMINATION IN THE USE OF PUBLIC FACILITIES.

SECTION 7. 42 U.S.C. §2000b, is amended to add “sexual orientation” and “gender identity” as prohibited bases for denial of equal use of public facilities as follows:

a. The terms “sexual orientation” and “gender identity” are defined as in Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e.

b. Section 2000b(a) is amended every time the phrase “race, color, religion or national origin” occurs by inserting after the word “religion” the following words:- “sexual orientation, gender identity,”

c. Certain Shared Facilities. Nothing shall be construed to establish an unlawful practice based on actual or perceived gender identity due to the denial of access to shared shower or dressing facilities in which being seen fully unclothed is unavoidable, provided that the proprietor provides reasonable access to adequate facilities that are not inconsistent with the individual’s gender identity as established with the proprietor at the time of the relationship first began or upon notification to the proprietor that the individual has undergone or is undergoing gender transition, whichever is later.

E. DISCRIMINATION IN ACCESS TO CREDIT.

SECTION 8. The Equal Credit Opportunity Act of 1974, 15 U.S.C. §1691 et seq., is amended to add “sexual orientation” and “gender identity” as prohibited bases for discrimination in any aspect of a credit transaction as follows:

a. The terms “sexual orientation” and “gender identity” are defined as in Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e.

b. Section 1691(a)(1) is amended every time the phrase “race, color, religion, national origin, sex or marital status, or age” occurs by inserting after the word “marital status” the following words:- “sexual orientation, gender identity”.

F. DISCRIMINATION IN FEDERALLY FUNDED PROGRAMS OR ACTIVITIES.

SECTION 9. Title VI of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000d, is amended to add “sexual orientation” and “gender identity” as prohibited bases for exclusion from participation in, denial of the benefits of, or being subjected to discrimination under any program or activity receiving Federal financial assistance, as follows:

a. The terms “sexual orientation” and “gender identity” are defined as in Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. §2000e.
b. Section 2000d is amended every time the phrase “race, color, or national origin” occurs by inserting after the word “color” the following words:- “sexual orientation, or gender identity,”

c. The provisions of this section regarding sexual orientation and gender identity shall not apply to any educational institution, as that term is defined in 20 U.S.C. 1681(c), which is controlled by a religious organization if the application of this subsection would not be consistent with the religious tenets of such organization as determined in its sole discretion.

G. DISCRIMINATION AGAINST PEOPLE WITH DISABILITIES.

SECTION 10. The Americans with Disabilities Act of 1990, as amended, 42 U.S.C. §§12101 et seq., and the Rehabilitation Act of 1973, as amended, 42 U.S.C. §706, are amended to repeal discriminatory provisions, as follows:

a. 42 U.S.C. §12208 is repealed.

b. 42 U.S.C. §12211(b)(1) is amended to delete the words “transvestism” and “transsexualism” and the phrase “gender identity disorders not resulting from physical impairments,” from the definition of “Certain conditions” excluded from coverage under the Act.

c. 29 U.S.C. §705(8)(F)(i) is amended to delete the words “transvestism” and “transsexualism” and the phrase “gender identity disorders not resulting from physical impairments,” from the list excluding from protection an ‘individual with a disability’ for purposes of Section 501, 503 and 504 of the Rehabilitation Act.

simplicity in the name of a movement

What happened to our LGBTQI movement?  Since 1970, post Stonewall, – Good question.  Nothing. We have a quest for gay marriage rights, we have a quest for social security, we have a quest for immigration equality, to serve in the army, to not have crimes committed against us because we are gay, we have a quest for employment equality and the list goes on.

We are denied many rights in many States under State Law

We are denied 1,137 rights on a Federal Level

For almost 40 years we have been rallying around organizations,  while they advance their ownership- of the future of our rights,which has ultimately turned into a cannibalization of our movement.

There is NO MOVEMENT eat has been chomped at and is now in pieces called DADT, ENDA, DOMA – What do we really want?Is it not complete equality – The color of my skin is GAY!

Environment:

• BAD:

We are stuck in a milieu of Republican obstructionists,
an election (midterm) about to happen
a majority in Congress
a President the victim of serious racial attacks and unprecedented disrespect
Catholic Bishops and Evangelicals impacting Congress and the separation of Church and State.

• GOOD:
• Is this any different from USA as usual?
• Well we have one advantage at this time -a majority in Congress.  (ah but the elections! Oh well that lasted a minute!

How does this comport?  The current environment  only precludes piecemeal legislation-and yet we forge on the same path to nowhere.

Our LGBT organizations have formed mostly around specific arenas of our struggle, which has actually wedged us all into compartments in our activism. There has been no Universal message for our movement.  Guess what? That is the tone the USA public has been hearing and so they are accepting the tone we have set.  Our own attitude by way of how we approach our rights- asking for a little at a time – reflects uncertainty and insecurity- it  has done little more than to make us look as if we believe we agree with our marginalization.

The closest endeavor to universal message is “marriage”  and that one is fraught with problems. Why? Because it sets us up for the religious arguments which have been working successfully against us and also for the “leave it to the States” excuse also working against us.

I believe all is not negative and I do not look back along the path of the past and say ‘oops we made a mistake.’  No, we did not; it was our path and it is done and it has gained a lot for us by way of visibility. There is so much more that is acceptable that was not and the marriage road has given us a good measure of legitimacy and won us many friends.

But what I am critical of, is our failure to take stock when we enter crossroads and I believe we are at one right now.

In other words we cannot go forward in the same direction, we must choose a left or right turn and then we can forge a new road. The left turn is = do something completely different and the right turn = do the same thing.

What we have going for us is a Volcano about to erupt and we must harness that energy in a way that will work.  The first little eruption can be noted by GET EQUAL’S push for Choi et al – chaining themselves to the White House fence in the hope of getting attention – because in truth that is all they may have accomplished and yet did not.  It caused more harm and the energy was not favorably harnessed. (see earlier posts)

So back to my point – the larva bubbling under are all of you who have “equality” as a middle name or in the fore of your mind and others of you who are of good conscience and allies.

So now it is time to utilize what is emerging from beneath – let us take the left turn here. The organizations and leadership can join in or they can crawl like tortoise to the finish line taking the right path.

The Left path is the PINK PRINT – it takes us right back to the beginning – what it does is it gives us the cement – the foundation for equality. If we have a Civil Rights Amendment to the ACT of 1964 – where we ask for one thing – not 100 things. Just one thing. If we pool everything we have into this one thing; hence the number  …1… significantly displayed on the PRINT… and ask for what we are entitled to  A CIVIL RIGHTS AMENDMENT to include the word “sexual orientation” and “gender identity,” placed neatly next to the words “race and gender,” we would be setting the foundation for the Mansion to come….

After that our right to  equality is solidified and we cannot be denied anything thereafter.   What will fall will be an Omnibus to repeal all discriminatory law. We will not need ENDA and DADT will fall. As for UAFA – we will no longer have the problem as all the DHS will have to do will be to change their forms a little.

So Find me a champion. Find us a Senator and a member of the House.  Who wants to join this PINK PRINT? Who wants to have a one Goal Movement ?  For 40 years we have tried the other way and we are still begging for one piece of miserable legislation that a gay friendly President has yet to support to the point of passage.

What do we have to lose?

Our lives are no one’s priority – we must stop relying on those who do have a lot to lose  – we are gong to have to make sacrifices and do this from the bottom up – so to speak.  The leadership can follow. But please leadership, HRC,  et al, do not tell us to be patient while you fight for one piece at a time.

There IS no such thing as not possible. But it sure is not possible if you don’t not try.

Welcome to WikiMeg – where we can all participate to counter the obscene spending of Meg Whitman  in the name of  her ego and at the expense of our LGBTQI equality.

by Melanie Nathan – Posted on 08 March 2010.  This morning the website “Level the Playing Field 2010″ launched www.WikiMeg.com, the first open source, political research site of its kind – open to all, by all and for all.  At “Level The Playing Field 2010,{ the organizers  are embarking on a bold new experiment in democracy.

“We hope the WikiMeg space will serve as a digital laboratory for free speech. It’s based on the idea that by harnessing the collective brainpower of millions of Californians, we can help level the playing field against Meg Whitman’s $200 million television campaign. ” say the organizers.

I personally have been nauseated by the thought that one person can dedicate and may spend  that much money to a self serving endeavor that in essence will cost us, our LGBT community, much more than money can buy -  our progress.  I am sick at the thought that she will pay that much money to be elected into a position for which, in my opinion,  she is entirely unqualified. What makes matters worse is that she is using the money we spent selling and buying on E-bay – the biz from which she fed.

Further, I am  throwing up - from an LGBT perspective; imagine this billionaire spending her own $200 million dollars so that she can attain the governorship of California, to effectively veto any LGBT necessary legislation and hence our progress in California.  We all know that what happens in California impacts the whole country and for us in the queer community.

Soon California State Senate will hear testimony to promote AJR15, a California Resolution in support of UAFA.  There will be a proposition on ballot to to rid us of Prop 8 – we need our Jerry Brown – not a Meg-a-Million!

Even worse, now vomiting, at the thought of how $200 million dollars could be effectively used by way of a donation to our State – to help the homeless, the hungry, the foreclosed and you know the rest of it.

So as I try to recover from my very explicit and graphic sick episode, I realize we do have hope thanks to LEVEL THE PLAYING FIELD 2010. Participating in the experiment looks like a lot of fun.   Lets get our detective and Paparazzi hats on and more importantly the hat bearing “Citizen for true Democracy” and do  our ‘intelligence’ justice.

I implore our readers here at LGR to pass this message along.  This brilliant idea from  Level the Playing Field, and I quote from the site:

Meg Whitman, the pro Prop 8 Republican Gubernatorial wannabe, who landed in CEO butter a mere six months before EBAY went public, is now using those very consumer dollars- and an estimated 150 million of them to pony up an early bid to buy California.

California is the bastion of the same-sex marriage struggle – we have fought so hard here, spent millions of dollars against religious tyrants stomping on our rights -to pursue our happiness, – to have our families lodge safely in equal regard, only to risk being second class citizens in the paid for world of anti-gay marriage proponent Meg Whitman.

Does she scare me?  Yes she does because she wields a dangerous purse; her money is her AK-47.  She rears her head into the last realm of the billionaire ladder – corporate power done!  Political power next!

For those of you who are not in California, the Whitman blitz has started, with ads courting Californians portraying Whitman as the answer to all our financial woes.   But fellow second class citizens – this is no friend to California – this is a power hungry CEO who is bored and desperately seeking the type of relevance that hopefully not even money will ultimately buy.  Mark my words; this woman has the presidency in her glaze; and she will continue to spend, use and abuse until she attains the ultimate crown.

According to ‘Level the Playing Field 2010,’ a coalition of concerned Californians, organized to promote a fair fight in the November elections, and whose mission is to make sure the billionaire Republicans answer the tough questions about how they plan to fix  California found at   http://www.leveltheplayingfield2010.com/about/  :

“Whitman has already spent $30 million and is on pace to spend a record $200 million dollars of her own money to paint you a perfect picture about her on TV.

Yet, she refuses to answer basic questions about her record while as CEO of eBay or working as a Wall Street corporate management consultant. She ducks the press, does almost no public events and rarely – if ever – actually answers questions from the public.  We face tough times and those who would be Governor need to answer the tough questions about how they are going to solve our most challenging problems – not just create picture perfect TV campaigns.”

Pretty picture perfect ads ought not to cut it. Californians want feet to the fire answers with detail and specifics, and fair treatment for all.

So at this critical stage of the game, with stakes so high for LGBTQI community, we cannot underestimate the power of the hundreds of millions to buy our airwaves, and the danger that presents to us in this entire Nation.  We must not repeat mistakes and nor should we be intimidated – keep your eyes, ears  and wallets open to do whatever you can to help ‘level the playing field in 2010.’

Right now, my suggestion is visit the site http://www.leveltheplayingfield2010.com/about/ and show them a few dollars, because the stronger the coffer,  the better the fight!   Wherever you may be, the California elections this year are crucial and are probably the most profound for the LGBT community.  This is the citadel and we must rid it of those who by turning their backs on equality, in truth set us back by decades.

With her bid to be California’s governor, Meg Whitman, the billionaire former CEO of eBay, is leaning hard to the right. Her support of a gay marriage ban could doom her campaign.

“While Arabica was introduced at the beginning of the 1900′s, Robusta coffee is indigenous to the country, and has been a part of Ugandan life for centuries. The variety of wild Robustacoffee still growing today in Uganda’s rain forests are thought to be some of the rarest examples of naturally occurring coffee trees anywhere in the world. The coffee trees are inter cropped with traditional food crops and grown in the shade of banana trees and other shade trees. In these self-sustaining conditions, coffee is left to grow naturally, flowering on average twice a year.

Uganda has the unfortunate circumstance of being landlocked, and needing good relations with its neighbors to move its coffee crop to a port city. Transportation bottlenecks can result in containers of full of steaming coffee beans stuck on the back of a truck or a dock somewhere …not good for quality! But in recent years the problems of unstable East African politics and weak infrastructure seem to be improving, judging from the excellent quality coffee coming from the Northern Bugisu region along the Kenya border. Good marks are the Mbale Bugisu Coffee Factory and the Budadiri Coffee Factory -names of the mills where the coffee are prepared. Good Ugandan coffees are both unique among East African coffees and of intense character. Germany has been a strong buyer of Ugandas arabica crop but two years ago the outrageous Java prices resulted in numerous containers appearing in the US as a Java substitute.

Coffees from politically unstable regions, especially East Africa and the 10-year civil war in Uganda, bring up ethical issues. But the plain fact is this: coffee is a cash crop. It is grown by 300,000 small-holder farmers in Uganda. It is 95% of the Ugandan exports and 2,800,000 people rely on it for a living! Most production is Robusta, and the prices they get are low. Arabica farming is more work, but the rewards are greater! Quality in coffee is a way to break pay farmers better. Here you have the opportunity to buy the best of Ugandan coffee… “

 Dear Ugandan Exporter ,  

We treat all Ugandans as one!  Until you work as a community to rid yourselves of the pre-genocide attacks on the LGBT community in your country of 32 Million people, we plan to boycott your trade. we will not do any of the following: 

Attend your buyer seller meets   regardless of where; attend in-bound and out-bound trade missions; participate in contact promotion programmes; support you in participation of Ugandan exporters in relevant local, regional and international trade fairs and exhibitions; utilize your expert industry counselling;  and forget those presentations at international export promotion workshops, seminars and conferences cause we wont be there! and most of all WE WILL NOT BUY YOUR COFFEE -

We at Lezgetreal support the gays and homosexuals and lesbians in Uganda; it is not a crime to be a homosexual or lesbian in our world, but we are not welcome to yours.  (LGBTQI) Your attempts to criminalize homosexualitydefies all understanding, as it is clear that it emanates from nowhere other than biblical teaching of the likes of sickos like Scott Livelly, et al.  If you choose to be a Church State, then make that announcement openly and give people who do not believe in what your State stands for, an opportunity to leave Uganda, before you criminalize them. 

That said, without much ado, we will not tolerate this kind of persecution from any country.  We are going to boycott your country.  You economy has grown and you are improving your poverty. I hope you do not choose to force your Country into poverty yet again.  You must get rid of the hate Gay Bill.  Completely.  Regardless we are starting the boycotts immediately. 

If you enact this law, then many people from foreign countries dare not come to Ugandan, for example what if a political trade envoy is gay?   If he comes to your land, he is a criminal.  Why would any corporation want to support your country.  You are asking to be kicked out of the World economy and we are ready to oblige. So here goes America…. Write to the following Companies and tell them what we plan to do. This will go viral and millions of people will see this as well as the US Congress.

The 17 Bristol Farms locations are spread throughout Southern California and one is in San Francisco. The store is really high end, so you might not be aware of the chain of stores if you are not in the area of one. The first store happens to have been opened up in Rolling Hills which is about 10 minutes away from my house so I am a big fan of Bristol Farms. My wife and I have a lot of good memories spending time shopping at Bristol Farms while we were dating.

Now that I know they are gay friendly it makes me that much more happy to spend my Pink Money with them!

The reason I am doing this is for those of us in the LGBT community to become familiar with businesses that support us. For my first Pink Money Post I am bringing you a Whopper! Literally. Burger King is a global fast food chain popular for their flame broiled patties and their promise to ‘Make it YOUR Way’. Burger King is the home of the Whopper, which is a burger fixed with all the trimmings. This fast food chain is also a member of the National Gay and Lesbian Chamber of Commerce! I suggest if you are out and about and need a quick bite to eat, look out for a Burger King sign!

As a lesbian mom I can appreciate BK, because they always have toys in their kids meals that my kids think are popular.

Aside from their main website, they also have ClubBk.com for the kiddos too, and they promote well-balanced meals along with an active lifestyle for all children. Burger King offers a value menu where you can order value priced items including my favorite, the Whopper Jr. My children used to love to play in the play area at the Burger King here in Carson, but ever since it moved we have been a bit sad. However, knowing that BK is a member of the NGLCC gives me a good reason to seek one out, and hopefully you will too. )
